NOW, TI-IEREFORE, BE IT RESOLVED by the Board of Supervisors that the agreement attached hereto as Exhibit A be incorporated herein as if set forth in full, and is hereby approved and executed by Butte County. NICHOLS, Chief Administrative Off~cer and C erk of the Board of Supervisors By AGREEMENT 1 This Agreement is made and entered into this 31St day of JanUdry 2 19 84, by and. between the County of Sutte, a political subdivision of the State 3 of California, and the Thermalito Irrigation District, ~ an independent special dis+,rict authorized by the 6 g WHEREAS, part 0.5, of Division T, Section 99, Subdivision B, paragraph q 5 of the Revenue and Taxation Code pz~ovides as follows: g "Tn the event that * * * a jurisdictional change would g affect the service area or service responsibility of one 10 or more special districts, the board of supervisors of the 11 county or counties in which " * the districts are located 3Z shall, on behalf of the district or districts, negotiate any 13 exchange of property tax revenues." 34 WHEREAS, said section of the Revenue and Taxation Code further 15 provides in Section 99.1, Subsection (a}, paragraph 3: Ii 18 "Notwithstanding the provisions of paragraph (5} of 17 subdivision (b) of Section 99, any special district affected lg by the jurisdictional change may negotiate on its own ' 39 behalf, if it so chooses." - , S0 WHEREAS, Section 99 further provides in Subsection B, paragraph 8, 21 subpart (d): 22 "With respect to adjustments in the allocation of property , 23 taxes pursuant to this section, a county and any local agency 24 or agencies within the county may develop and adapt a master 25 property tax transfer agreement. Such agreement may be revised 28 from time to time by the parties subject to such agreement."
