RESOLUTION APPROVING AND EXECUTING AN AGREEMENT
BETI4EEN THE-NORTH BURBANK PUBLIC UTILTIES
DISTRICT AND THE COUNTY OF BUTTE REGARDING THE EXCHANGE
OE PROPERTY TAX REVENUES RELATED TO
THE"ORCHARDS ANNEXATION
WHEREAS, the provisions o£ the Revenue and Taxation Code
require an agreement between the County of Butte and special
districts considering annexation.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors
that the agreement attached hereto as Exhibit A be incorporated
herein as if set forth in £ull, and is hereby approved and
executed by Butte County.
PASSED AND ADOPTED by the Butte County Board of Supervisors
this 31st day of January 1984, by the following
vote:
AYES: Supervisors Dolan, Fulton; Moseley, Wheeler and Chairman Saraceni
NOES: None
ABSENT: None
NOT VOTING: None

of California, and the Plorth Burbank Public Utilities District,

g WE[EhE;AS, Part 0.5, of Division I, Section gg, Subdivision B, paragraph
q 5 of the Revenue and Taxation Code provides as follows:
8 "In the event that * '" a jurisdictional change would
g affect the service area or service responsibility of one
10 or more special districts, the board of supervisors of the
lX county or counties in which * * * the districts are located
12 shall, on behalf of the district or districts, negotiate any
13 ,exchange of property ta.x revenues."
14 4IHE;REA5, said section of the Revenue and Taxation Code further
15 provides in Section 99.1, Subsection (a}, paragraph 3:
16 "Notwithstanding the provisions of paragraph (5) of
17 subdivision (b) of Section 99, any special district affected
~g by the jurisdictional change may negntiate on its own .

19 behalf, if it so chooses." ~
20 WHEREAS, Section 99 further provides in Subsection B, paragraph 8,
Q1 subpart (d):
22 "With respect to adjustments in the allocation of property
23 taxes pursuant to this section, a county ar_d any local agency
Ztl or agencies within the county may develop and adopt a master
25 property tar, transfer agreement. Such agreement may be revised
28 from time to time by the parties subject to such agreement."
