HomeMy WebLinkAbout84-022BOARD OF SUPERVISORS CC2L1N7Y pl= BUTTE, , S7ATE OF CALIFORNIA, Resolufion No. 84-22 RESOLUTION OF THE BOARD OF SUPERVISORS ESTABLISHING THE COUNTY COURTHOUSE TEN3PORARY CONSTRUCTION FUND WHEREAS, the Board of Supervisors is required by law to provide suitable courtroom facilities; and WHEREAS, the ability of the Board to acquire, rehabilitate, construct, finance and lease such facilities, including all facilities necessary or incidental to the operation thereof, and to provide for the payment or repayment of obligations entered into for such purposes, is severely strained by reason of limitations upon county revenues; and WHEREAS, to assist in the establishment of adequate courtroom facilities, Section 68073.6 of the Government Code and Section 1206.8 of the Penal Code provides for the creation of a Courthouse Temporary Construction Fund (the "Fund"), and the imposition of certain surcharges upon filings for all criminal cases to be deposited into such fund; and WHEREAS, Section 68073.6 of the Government Code and Section 1206.8 of the Penal Code become operative upon the adoption of a resolution by the Board stating that these laws are necessary to the establishment of adequate courtroom facilities in the county; NOW, THEREFORE, the Board of Supervisors of the County of Butte does hereby resolve, declare and determine as follows: 1. The foregoing recitals are adopted as a part of this Resolution. 2. Implementation of the provisions of Section 68073.6 of the Government Code and Section 1206.8 of the Penal Code are necessary to the establishment of adequate courtroom facilities in the county. 3. Pursuant to these laws, there is hereby established in the County's treasury a separate trust fund known as the Butte County Courthouse Temporary Construction Fund. -z- 4. There shall be deposited in the Fund one dollar ($1.00) for every ten dollars ($10.00) or fraction thereof, upon every fine, penalty, or forfeiture imposed and collected by the courts for criminal offenses, as authorized pursuant to Penal Code Section 1206.8(a)(2). 5. The Clerk of the Board of Supervisors is instructed to transmit a copy of this Resolution to the judges of the courts of this County and to any entity within this County that processes and/or collects upon every fine, penalty or forfeiture imposed for criminal offenses with the request that the bail schedule amounts be increased as appropriate to reflect the surcharge provided for by Section 1206.8(a)(2) of the Penal Code, effective March 1, 1984.
