RELATIVE TO APPROVING TENTATIVE CANCELLATION
OF THE WILLIAMSON ACT FOR MIDWAY ORCHARDS
WHEREAS, this Board adopted Resolution 84-11 on January 24,
1984, relative to approving tentative cancellation of the Williamson
Act for Midway Orchards; and
WHEREAS, Section 3 of the determinations and findings needs
to modified to reflect a change in the fee payment requirements, and
to further declare that this amendment is not a project for the
purposes of the California Environmental Quality Act;
NOW, THEREFORE, BE IT RESOLVED, by this Board that Section 3
of Resolution 84-11 is amended to read as follows:
3. Cancellation of the Land Conservation Act contract for
the Midway Orchards property is subject to the payment of cancellation
fees in the amount prescribed by statute and determined by the
assesor. Those fees are to be paid on the approval by the County of
all the discretionary actions referenced in Sections 4 below and
before the County records a certificate of cancellation of contract
to finalize the tenative cancellation.
BE IT FURTHER RESOLVED that this Board finds this amendment
to Resolution 84-11 is not a project for the purposes of the California
Environmental Quality Act.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California, this 20th day of March, 1984, by the
following vote:
AYES: Supervisors Dolan, Fulton, Moseley, Wheeler
and Chairman Saraceni
NOES None
ABSENT: None
NOT VOTING: None
