RESOLUTION FOR SUMMARY ABANDONMENT
FOR A PORTION OF SKYWAY AT NIAGALIA
WHEREAS, a portion of Skyway right of way is no longer necessary
or required for road purposes; and
WHEREAS, pursuant to the Streets and Highways Code Section 960.1,
the Board finds that a portion of Skyway right of way should be summarily
vacated;
NOW, THEREFORE, BE IT RE50LVED by the Board of Supervisors of the
County of Butte, State of California, as follows:
The following described portion of Skyway right of way is hereby
summarily vacated and abandoned pursuant to Streets. and Highways Code
Section 960.:1:
A portion of the northwest quarter of Section 31, T23N, R4E, MDB&M,
more particularly described as follows:
Beginning at the northwest corner of that certain parcel deeded to
A11ene M. Chabala, February 17, 1978, and recorded in Book 2257 at Page 269
in the Office of the Recorder, County of Butte, State of California; thence
along the westerly extension of the northerly Line of the said Ghabala parcel
to a point 40.00 feet easterly of the Skyway centerline as it is existing in
1984; thence southerly along the said easterly right of way line, being 40.00
feet east of and parallel with the said centerline of Skyway to its intersection
with the westerly line of the said Chabala parcel; thence northerly along said
westerly line of the Chabala parcel to the said northwest corner of said parcel
and the point of beginning.
Containing an area of .06 acre more or less.
EXCEPTING AND RESERVING any existing easements and/or rights at any
time, or from time to time, to maintain, operate, replace, remove, renew and
enlarge- the existing public utility facilities and facilities incidental thereto,
including access to protect the property from ail hazards in, upon, and over
the h~;~hway herewith to be abandoned.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte,
State of California, this i2th day of ,3une 1984, by the following vote:
