IZesolufion No. 84-123 RESOLUTION GIVING NOTICE OF HEARING ON PETITION FOR FORMATION OF WESTERN CANAL WATER DISTRICT WHEREAS, this Board has received a petition for more than 50 percent of the owners of land within the proposed Western Canal Water District requesting formation of said district and described in Exhibit "B"; and 4JHEREAS, pursuant to Water Code Section 34168, this Board shall set a date fora hearing on the petition for formation of the proposed water district. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: 1. The undertaking received in regard to-the Western Canal ldater District formation costs should the District not be formed is found to be sufficient. 2. The Clerk of the Board is ordered to give notice by publication as set forth in Water Code Section 34168 and in the form attached as Exhibit "A" hereto of the time for hearing', upon the Petition for Formation of the proposed ~rlestern Canal Water District. 3. That this Board hereby gives notice that at its regular meeting on September 18, 1984at 10:00 a.m., in the Board of Supervisors' Chambers, 25 County Center Drive, Oroville, Califronia, a hearing shall be held on the formation of the proposed Western'Canal Water District as described in Exhibit 'B" attached hereto. NICWOLS, Chief Administrative Officer and Clem of the Board By NOTICE OF HEARING TAKE NOTICE that on August 28 1984, at the hour of 10:00 a.m., the Board of Supervisors of the County of Butte will consider the Petition for Formation of Western Canal Water District. A Petition for Formation of said District was presented to the Board of Supervisors on July 31 1984. The text of the Petition is as follows: PETITION FOR FORMATION OF WESTERN CANAL WATER DISTRICT ' ', The undersigned herewith petitions the Board of Supervisors of the County of Butte for the formation of a California Water District pursuant to the provisions of Section 34000 et. seq. of the Water Code of the State of California, Division 13. ' 1. The name of the proposed district shall be the Western Canal Water District. 2. Attached hereto and by this reference incorpora- ted as Exhibit "A" is a map of the proposed District, along with. a description of the boundary of the proposed District. 3. The District shall lie in the Counties of Butte and Glenn, with predominate acreage within Butte County, California. 4. The District shall contain approximately ',57,000 acres, of which approximately 45,000 are irrigable. 5. The principle place of business of the District 'shall be Nelson, California, at offices currently occupied by pacific Gas & Electric Company for operation of its Western Canal System. --1- ~, ___., 6. Water from the District shall be provided '.from existing contracts between Pacific Gas & Electric ',Company and the Department of water Resources, utilizing '..water rights possessed and developed by Pacific Gas & ',Electric Company. 7. Consolidation of the office of assessor and tax collector is requested, and that such offices be filled by appointment. 8. The undersigned attest that they are the 'owners of more than 50$ of the land in said Water ',District, and respectfully request that proceedings for ',the formation of the District be initiated.
