RESOLUTION FOR SUMMARY ABANDONMENT FOR A
PORTION OF OLD SKYWAY AT MAGALIA DAM
Resoluf~on NO.84-130
WHEREAS, a portion of the Old Skyway right of way is no longer necessary
or required for road purposes; and
WHEREAS, pursuant to the Streets and Highways Code Section 960.1, the
Board finds that a portion of the 01d Skyway right of way should be summarily
vacated;
NOW, THEREFORE, BE TT RESOLVED by the Board of Supervisors of the County
of Butte, State of California, as follows:
The following described portion of the Old Skyway right of way is hereby
summarily vacated and abandoned pursuant to Streets and Highways Code Section 960.1:
All that portion of the Old Skyway right of way T~'ng southwesterly of the new Sky-
way right of way at the Magalia Dam, also being a portion of the southeast one-
quarter of Section 25, T23N, R3E, M.D.B.& M., and the northeast one-quarter of
Section 36, T23N, R3E, M.D.B.& M., more particularly described as follows:
From a point of beginning, being on the centerline of the Old Skyway right of way,
which point bears N 39°52'39"-W, 562.67 feet from the southeast corner of said
Section 25, northwesterly along the center of said Old Skyway right of way to its
intersection with the southerly right of way line of the new Skyway right of way
easement, also '.those portions within the above described area that are described
in the following deeds for Old Skyway right of way, Book 169, Page 191, and Book 217,
Page 363, as recorded in the Office of the Recorder, County of Butte, State of Cali-
fornia.
EXCEPTTNG AND RESERVING any existing easements and/or rights eti 'any time, or from
time to time, to maintain, operate, replace, remove, renew and enlarge,-;the existing
public utility facilities and facilities incidental thereto, including access to
protect the property from all hazards in, upon, and over the highway herewith to
be abandoned. --
