OF BUTTE, ST,4TE OF -CALIFORNIA N, Resolufion 1Vo. 84-155 RESOLUTION OF THE 80ARD OF SUPERVISORS ' OF THE COUNTY OF BUTTE AUTHORIZING THE FORMATION OF AND ESTABLISHING THE ' BOUNDARIES OF THE PP.OPOSED WESTERN CANAL WATER DISTRICT YJHEREAS, a Petition of Western Canal Water Users' Association has been filed with the Board of Supervisors requesting formation of the proposed Western Canal 'dater District; and WHEREAS, the Board of Supervisors has accepted said Petition and authorized notice of hearing of said Petition as required by the provisions of Sections 34180 and 34181 of the Water Code; and WHEREAS, the Board, on September 18, 1984, at the hour of 10:00 a.m., conducted a''public hearing on the formation of the proposed District, and has heard all relevant evidence in support of or in apposition to the Petition; and WHEREAS, the Board has determined that the boundaries of the proposed District, as submitted with the Petition, and as described on Exhibit "A" attached hereto, has been properly drawn and includes all lands which will be benefitted by the water service of the proposed District; and WHEREAS, the Board, based on the evidence presented, has determined that no additional land should 6e included within the boundaries of the proposed District due to limited water capacity in the proposed District; and WHEREAS, the Board has determined that no lands included within the Petition as'being within the District should 6e excluded as not being benefitted by the water service tv be provided 6y the proposed District; and WHEREAS, the Soard finds that the Petition conforms to the requirements of Di vision'13 of the Water Cade of the State of California, and that the required notice of the hearing has been given. NOW, THEREFORE, 8E IT RESOLVED by the Board of Supervisors of the County of Butte that the Board does hereby establish and describe the exterior boundaries of the proposed Western Canal Water District as being those boundaries depicted on Exhibit '!A", attached hereto, and 6y this reference incorporated herewith. -2- BE IT FURTHER RESOLVED that the proposed District shall 6e cal3ed WESTERN CANAL WATER DISTRTCT. BE IT FURTHER RESOLVED that the offices of Assessor and Tax Collector shall be consolidated, and shall 6e filled 6y appointment.
