NOW, THEREFORE BE IT RESOLVED by the Butte County Board of Supervisars, State of California, as follows: 1. The Chairman of the Board is authorized to sign the attached contract, any amendments, or extensions, between the County of Butte and the California State Board of Corrections for the expenditure of $1,000,000 state and $873,513 county funds for the construction of Butte County Minimum Security Work Furlough Facil ity. 2. Appointed James L. Johansen, auditor-controller to act as trustee for the project. 3. Appoints P1artin J. Nichols, chief administrative officer, to act as Project Director and contact person for the project. 4. County agrees to appropriate the necessary matching funds far the project. Morris, Project Director State Board of Corrections 600 Bercut Drive Sacramento, CA 95814 Dear Martc: Please find enclosed eight ($) signed copies of the contract between the State Board of Corrections and the County of Butte for construction of the Butte County Minimum Security/Work Furlough Facility as part of the County Jail capital construction fund grant. Rlso enclosed, and a part of the contract, are eight (g} certified copies of Butte County Board of Supervisors' Resolution 84-195 naming the project director, financial officer and agreeing to appropriate the necessary funds fnr the project. Additionally, reference is made to your letter of November 19, 1984 to Mike Pyeatt of my staff requesting comments of clarification to our contract. These points are identified and. summarized below: 1. Minor differences between ro'ect a lication and contract. The original application for $1 million funding identified a minimum security/work furlough facility which could be expanded to 160 beds. In the contract, this has been reduced to l44 beds. There are basically three reasons for this reduction. a. Meeting{s} were held between Undersheriff Bruce Albert and our ~rchit eet, Gene Mc Farren, with Board of Corrections staff representative Neil Zinn. It was mutually agreed that Butte County would pursue a program wherein the designed expansion would be less than 160 beds, based upon the needs assessment study which had been performed. Neil Zinn, I believe, and perhaps rightfully so, felt that a 160-bed facil ity did not truly reflect the need in Butte County. b. Also, Neil Zinn strongly suggested a schematic design change which would allow for the placement of female prisoners in the minimum security/work furlough facility. Lastly, and perhaps more important, the cost difference between a 144-bed facility and a i6D-bed facility was significant enough to provide the impetus to scale the project down to its present size. 2. Medical Services, The funding application made mention of including medical services in the new facility, while the contract deletes this. There were two main reasons for this change in program. a. Because of the close proximity of the proposed minimum security/work furlough facility with- the main jail, it was -felt one over- all location would better suit the needs of the county and would realisti- ca11y be more cost beneficial. Also, consideration was given to the fact that if it became necessary to provide around-the-clock direct medical supervision, the more secure facil ity would be a more proper location. b. When the original application was filed, the county was conceptionally reviewing the feasibility of contracting for health services for inmates. This his now become a reality wherein the county has contracted with Prisoner Health Services, Inc. Complete medical coverage can now be provided in our main jail facility. 3. Financial Plan. Page A-5 of the contract has been updated to reflect the selection of the disbursement option for receiving state funds. This is in accordance with Exhibit B, Article 14. 4. Cash Flow Pra,Zctions Please note that minor amendments have been made to our cash flow projections in Fiscal Year 1984-85. These changes, however, are only in regard to the utilization of county funds from one period to another, 5. ."Hard Match" Construction ManacLement. Contained herein is an explanation of our planned utilization of project/specialty inspectors as differentiated from public building inspectors. a. Public Building Inspectors - These are the Building Depart- ment's field inspectors who are responsible for compliance with local and state codes, rules, regulations, and ordinances. Thus, their responsibility is to the Building Department. December 12 , 198 b. Project inspectors - These are the inspector(s) who represent the owner on the project to insure quality control and are responsible for the duties and responsibil ities autl fined in the attach- ment. While responsible~to this owner, their activities are directed by the architect and, obviously, represent a different level of in- spection services than the public building inspectors. c. Specialty inspectors - These are the inspectors and testing agencies who are retained to provide services which are not other- wise provided by either of the above. An example of this type of in - spector wool d be Kl einfel der & Associates, who wool d perform such inspectionand testing as reinforcing steel per ASTM specifications, concrete sample testing, and such other materials affecting the quality of material s suppl led. 6. Furniture/Equipment. Members of the Butte County Project Team have reviewed the provisions of Exhibit B, especially restrictions relating to the ex- penditure of state funds for program equipment and expendable items such as pots and pans, utensils, chalf/tack boards, etc. Butte County is intending to provide an amount ca nsiderably mare than the required 25~ match. As part of this process, we have tried to be as complete as possible in identifying all costs, rather than ,just those that are grant-fundable. These will be clearly dis- tinguished when requesting reimbursement. As far as the items set forth in Division 10 (chalk/tack board), we believe this will not be state-reimbursable, but the county is planning to assume 100 of the cost. Insofar as Division l2 (shelving}, this equipment is program prisoner-related for the storage of inmate property/personal belongings. We are also assuming that this will be a county cost. We would appreciate being. notified if your contract is going to be placed upon the State Board of Corrections "consent calendar" sa that representatives of Butte County may be in attendance to answer any questions which could conceivably arise. STATE OF CALIFORNIA COUNTY JAIL CAPITAL CONSTRUCTION FUND GRANT CONTRACT BETWEEN THE STATE BOARp OF CORRECTIONS AND COUP~TY OF BUTTE This contract is made this llth_day of Dece~ber 19~~, between the State of California, acting by and through the State Board of Corrections, hereafter referred to as the "Board," and the County of Butte, a County duly organized, existing and acting pursuant to the laws of the State of California, hereafter referred to as the "Grantee," WHEREAS: 1. This contract is authorized by Penal Code Sections 440fl through 4422 and 4450 through 4471. 2. The Grantee has made application fora grant for the Project hereafter described and has been determined by the Board to be el igi bl e for state funding pursuant to Penal Code Sections 4400 through 4422, and, Title 15, California Administrative Code, Section 500, et. seq.; and 3. PROJECT pESCRIPTION. The Project shall be known as Butte County Minimum Security/UJork Furlough Facility. The Project generally consists af: The proposed project is a 96 bed work furlough/minimum security facility encompassing approximately 15,500 square feet. This facility is designed so that it may be expanded to 144 beds encompassing approximately 21,000 square feet. The proposed project will be p1 aced an the existing county- owned property containing approximately 26.2 acres which have been identified as property to be used in completion of the Butte County Jail Master Plan. The proposed project itself will encompass approximately 3.0 acres. The facility will contain six dormitories with attendant day room. and bathroom space. It will also contain required space for administration, hearing, ventilation and air conditioning space, storage space, dining/recreation space, and a warming kitchen. We propose to provide a full range of services within the facility. Such services would include food service, laundry, commissary, visiting and recreational and educational programs. We would also operate our current vrork programs and workf school furlough programs out of the facility. SECTION 5. COMPLETION OF PROJECT. Grantee a grees to proceed ex pod i t io us i y with , and compl ete, the Project i n accordance with the grant application, plans and specifications as approved by the Board. SECTION 5. GRANTEE'S PAYP~ENT OF PROJECT COSTS. Grantee agrees to timely pay any and aTl costs connected with the Project, including, without limitation, any and all Project costs exceeding the Board share of the Project casts. SECTION 7. INDEMNIFICATION. The Grantee agrees to indemnify the State of California, the 8aard, and their officers, agents and employees against and to hold the same free and harmless from any and all claims, demands, damages, Tosses, costs, expenses, or lia- bility due to or incident to the design, constructions, operation, repair, maintenance, existence or failure of the Project. SECTION 8. TERM. Project Description. Provide a concise description of the exact project, or that portion ar phase of a project, to be completed with these grant monies and the required county matching funds. (I.e., number of beds and support activities being funded; square footage, etc.) The proposed project is a 95 bed work furlough/minimum security facility encompassing approximately 15,500 square feet. This facility is designed sa that it may be expanded to 144 beds encompassing approximately 21,000 square feet. The pro posed project will be placed on the existing county- owned property containing approximately 26.2 acres- which have been identified as pro perty to be used in comp?etion of the Butte County Jail Master Plan. The proposed project its el f will encompass approximately 3.0 acres . The project is designed to remedy a pro b1 em of overcrowding within two • existing dormitory units in which we currently house our minimum security/work furlough inmates. By removing the minimum security/work furlough inmates from the dorms in the main jail out to the proposed project, we can then spread- out the remain-der•o~f o+~r jail populatian•~vi•a our classi- ~ ~ ~~ fication system,-into the dormitory settings. A secondary benefit will be that we will be able to restrict community custody inmates from having access to the main jail . This will reduce pro b7 ems of introduction of contraband and the excessive staff time involved in the required searches and clothing exchanges. The facility will contain six dormitories with attendant day roam and bathroom space. It will also contain required space for administration, heating, ventilation and air conditioning space, storage space, dining/. recreation space, and a warming kitchen. We propose to provide a full range of services within the facility. Such service would include food service, laundry, commissary, visiting and recreational and educational programs. !+fe would a1 so operate-our current work programs and work/school furlough programs out of the facility. We intend to staff the facility with two posts an a 24-hour day, 7 days per week basis. We feel this is feasible due to the fact we are dealing with minimum security and community custody inmates, and the facility is adjacent to our current jail in the event any assistance is required. At the rate of $1507 per month fora Correctional Officer at the middle range, p1 us approximately 509 safety member benefits at $804 per month, the cost to staff the facility would be approximately $28,932 per year for one officer. To provide 24 hour per day, seven day per week coverage would require ten officers. This would cast approximately $290,000 per year. Extending this out for 10 years would be roughly equivalent to double the cost of the facility. A-i B. Project Activities. This section and the following section {C) should outline the grantee's basic construction management plan. This information should highlight the Grantee's contracting procedures (competitive bid or sole source), management procedures, and techniques that will be employed to monitor/ control the project. Identify individuals who are part of the project team and their functions. Contracting Procedure 1. Fiscal year 1985-86 funding covers furnishings for the completed facility, equipment for the warming kitchen and site work (fencing and security lighting)'around the main jail facility which are logically expenses incurred at the end of a project. The three-phase plan i ncl udes : - Phase I - Site Development Ahase II - Building Development and Gonstruction Phase III - Site Security.{fencing and lighting) and Equipment Acquisition The County feels it can gain valuable time in the overall construction of the project if it commences with the-site development and construction of the building pad before the winter rains. The county will then be in a better position to complete the necessary architectural drawings, submit the final drawings to the Board of Corrections and State Fire Marshal for necessary review and approval, place the project to bid, and commence construction in early spring. The result of this accelerated program will mean anticipated occupancy in October 1985, rather than in 1986. The project master schedule is set forth as follows: Phase I - Site Development 1. May 1984: Geological testing, topographic survey, architectural services. 2. June l 984 through August _1984: Project design in progress; site concept finalized and bid documents prepared for rough site development. A- 6 3. Se tember 1984 throe h October 1984: Rough site development project is advertised, awarded, constructed and completed. NOTE: Concurrently with the progress of Phase I, Phase II - Building Development will continue so as to coincide with the completion of site development work. Phase II -Building Development 4. June 1984 through December 1984 Architectural services; preliminary and final review by the Board of Corrections, State Fire Marshall and 1oca1 building department. Inspector selected by mid-November. 5. January 1985: Project advertised and out for bid. 6. February _985 through October 1985: Building project awarded; co.nstruction,.. shake-down -and- completion. NOTE: Co ncurrently with Phases I and II, Phase III - Site Security will progress so as to coincide with $0 percent completion of Phase II. This account shall be managed by a trustee (the "Trustee") • who has been appointed by the Grantee, ar by a. fiscal officer acting on the behalf of the Grantee with respect to the financing of the Project. B. Financial Provisions. 1~ lye Grantee shall have three options available for receipt of State funds. These options are: i (a) The Grantee may elect to advance that portion of the funds as are to-bye supplied by the State. In such case, the Grantee shall gro-- vide_the funds with which to make all payments as are appropriate and shall apply to the State,~at intervals mush ls~a~~r~~hupan, for reimbursement. The Grantee shall supply documentation supporting eligibility of expenditures an a monthly L..w~i n ' (b) The Grantee may elect to receive payments of the State's share of eligible costs an a monthly basis. Under this option the-Board shall process the request for the state`s share of the eligible expenses incurred. during the preceding month. There shall- be a minimum of one month between subsequent grant payment requests, (c) The Grantee may elect- to receive a quarterly advance of funds. if this option is selected, the grantee shall deposit its matching funds in the Capital Project FundlTrust Account in the same incremental proportion as the State funds. The Grantee's funds shall be deposited on or before the date the State-.funds are deposited. The State funds shall be deposited in the capital project fund/trust account in as amount not to exceed the Grantee's cash flow projections for a three-month period. ~o state funds shall be released from the capital project fund/trust account prior to this contract being fully executed. If this. option is selected the grantee agrees to insure that.the percent of interest earned oa State funds is maximized.. The. percent of interest earned on State funds shall be the same as or greaten than the percent of interest earned on Grantee funds. In na event shall the percent-of interest earned-be-less than.-the . percentage earned on the State's pooled investment fuads. All interest earned shall be credited to the capital project fund/trust account. pursuant to Government Code Section 53b47(b) and the provisions of this contract. {1) The interest earned by the Grantee's funds may be withdrawn by the Grantee at arty time. The interest earned by the State funds must be returned to the State at an interval of not more. than every six months commencing from the date the first State funds are received. (2) Quarterly statements of the remaining State and Grantee funds and. interest earned on the State and Grantee funds in the capital project fund/trust account shall be sent to the Board, by the Trustee until the capital project fund/trust account is closed. (d) The State wi11 endeavor to issue a warrant for eligible contract funds under 1(a), (b), or (c) above within 15 days of receipt of the counties documentation of eligible contract expenditures. All requests for payment shall be accomglanied by the appropriate expenditure form and such additional information and documentation as may be required by the Board. (1) Release of funds to the Grantee for payment to their contractor(s) shall be made only by written authorization of the Board's Executive Officer or designee and Grantee Project Director and Project Fiscal Officer. Normal construction delays or interruptions shall not constitute such refusal or inability; (4) Failure to provide the required local share of the total project costs necessary for project completian.. (5) Any other violation of the grant contract which significantly impairs the security of the grant funds, or, the ability of the Grantee t~o utilize. the funded facility far its intended and authorized purpose. C. In the event of such termination, pursuant to Article 15(B) above, Grantee shall, upon notification, refund to the Board an amount equal to all grant funds previously disbursed to the Grantee. Any grant funds so remitted to the Board shall include interest equal. to the rate earned-by the State Pooled Investment. Fund or the actual interest earned by the Grantee an the funds, whichever is greater. D. DISCUSSION OF ENVIRONMENTAL EVALUATION - The following impacts and concerns axe identified for this public project to increase the overall capacity of the jail by 163 beds {from 'f73 at present to a total of 336). Due to the ownership of the land by the County of Butte, the proximity to the Superior Court building, the relatively central location of the jail within the County, the surrounding uses being primarily county buildings with the nearest residential uses '/~ mile f away, the conformance of the proposal with the City of Oroville General Plan and zoning, the lack of .adverse public opinion received on the project at two public hearings, and the limited extent of the new construction for minimum security buildings apart from the main jail complex, the project is, not expected 'to result in significant-impacts which would require the preparation of an~environmental impact report (EIR).. Mitigation measures are recommended for the - -~ potentially significant factors, particularly additional traffic and the security lighting.. ~ . 1 a,h: Thee highly expansive- s~oiZa and the- 1oc~at~.nn ~of~the- -project -site ~ ~~ in an earthquake zone should be taken into account for the building design. " Special foundations may be required in light of these factors.. A soils engineer has taken soil samples from the site, laboratory tests have been run and the results referred to a structural engineer and the project architect: ~• '~ b,c: C.ompaction and o'vercovering of the soil wi21-result- from-~constructian of the minimum security buildings and related improvements, such as paved . parking areas. Grading for the building pads should be minimal. The topography is relatively level with gentle slopes in the proposed building area. - 2 a. An incremental decrease in the ambient air quality will occur from vehicular traffic associated with the expanded jail facilities. 3 b,c: An increase in surface water.runoff will occur. Drainage will be directed to the north and west along the canal and Highway 70. Off- site drainage improvements may be involved to adequately cDnvey the runoff to a drainage course or a broader area where percolation into the ground could occur. Adequate open areas are available between the existing jail and the juvenile hall to accommodate the construction of the minimum security buildings without removing trees. The fruitless mulberry trees may be removed and transplanted to the~hill south of the jail•complex for aesthetic purposes and erosion control, ~ a, b: Noise levels may increase to a degree as the jail facilities are _ enlarged to accommodate a gr?ater number of people. The main noise sources impacting the project area are vehicular traffic traveling on Highway. 7O to the west and occasional helicopter landizags in the portion of the jail parking lot nearest to tY~e canal. 7: Night lighting for security purposes would need to be shielded and directed so as to avoid distractions to passing motorists on the nearby roads and highway. Due to the location of the property below the grade of Highway 70, this factor may not be of great significance.. Hourever, the menus • high security building will be two stories in height, thus creating a potential problem in this regard. $ la: The proposal is not expected to conflict with uses on adjoining properties; including the residential uses within one--quarter mile to the east. Those people housed in the minimum security buildings should not pose a security risk to the surrounding community. Many of these people will be eligible to work outside of the jail complex during the day and return on evenings or weekends to'serve their sentences: $ b (cont.): Alternative sites for the jail expansion were not deemed necessary due to the location of the existing jail and the availability of County-owned land~on which to expand. .Future land uses in the vicinity may be more of a commercial nature than residential. Energy conservation features should be incorporated into the design of the new buildings, as well as renovations to the existin;; jail. Some possible features such as~eave overhangs and landscaping near the buildings would not be possible far visibility and security reasons. 13 a, b, c, e, f: An increase in vehicular traffic is expected due to the ~.ncrease in the jail capacity. Visitors to persons sentenced to serve time an the jail will be part of the traffic generation. A schedule will be het for visitors (probably a maximum of 5O at one time} to avoid traffic ~.d parking congestion. Additional parking areas may need to be developed adjacent to the minimum security buildings. Due to the presant and projected traffic increase, a deft--turn lane is recommended on County Center Drive near its intersection with the access road to the jail. This improvement would facilitate traffic movements.into and out of the jail complex. Sight distance .for motorists entering and leaving the jail complex from County Center•Drive is limited due to a curve in the road at this location. ~4.a-f: The proposal will increase the demand for various public services. hough the property is within the City of Oroville, some of the services would be provided by the Caanty of butte in this instance. Fire protection would be primarily the responsibility of the City of Oroville, though the county--state station on Nelson Avenue could respond more quickly in. the case of an emergency. The City of Oroville Police Department should have minimal involvement with the expanded jail facility of the Sheriff's Department. An adequate means to handle storm water drainage will be worked out with the-Butte County Public Works Department in conjunction with the City of Oroville Public Works Department, the California Department of Slater Resources and possibly Caltrans. 17 b: `This project to renovate the existing jail and construct minimum security buildings will be of benefit in avoiding potential, health hazards.
