AN ORDINANCE GOVERNING THE USES OF
LAND AND CONSTRUCTION AND USES OF
BUILDINGS ALONG THE SCENIC HIGHWAYS
OF THE COUNTY OF BUTTE
The Board of Supervisors of the County of Butte, State of
ifornia, do ordain as follows:
SECTION 1. For the purpose of promoting the public health,
ety and general welfare, and more particularly for the purpose
7 of preventing the creation of traffic hazards, pramoting the pros-
8 erity of the people of the County of Butte, conserving land values
9 along the Scenic Highways, promoting the comfort and happiness of
10 the people of the County of Butte, fostering pride in and attachment
ll to the said County, and promoting the public tranquility and good
12 order thereof, preserving and enhancing the public scenic and
13 aesthetic values, the Board of Supervisors of the County of Butte
14 does hereby ordain and set forth an "S-~T01 (Scenic Highways) District
15 d the following regulations established to govern the uses of lari
16 nd the construction and uses of buildings along the Scenic Highways
l'7 SECTION 2. The provisions of an "SOH" (Scenic Highway} Distrio
18 hall apply to all property lying an each side and within five
19 unfixed (500) feet from the centerline of the following highways:
20 a. Pentz Road, Paradise:
21 From State Highway 70 to the northerlymost boundary of
22 the Paradise irrigation District; and
23 b. Clark Road, Paradise:
24 Fxom State Highway 70 to the northerlymost boundary of
28 the Paradise Irrigation District,
26 SECTION 3. REGULATIONS.
27 The following regulations shall apply in an "S~H" District:
28 3.1 Uses permitted:
29 a. Lawful uses of land now established
30 b. Residential dwellings and accessory buildings
31 c, Agricultatxal uses and buildings
32 d. The following upon the securing of a Use Permit in each c se:

1) Schools, churches, public utility buildings and struc-
tures, roadside stands for the sale of produce from
the land fronting the highway within the district.
3,2 Additional uses permitted:
Certain additional uses axe permitted upon the securing of
a use permit in each case; said uses are highway services primarily
for the convenience of the traveling public and including:
a. Gasoline service stations
b. Restaurants
c. Motels and Trailer Courts
d. Public and quasi-public buildings and professional buildi.
SECTION 4. ADDITIONAL REGULATIONS.
~k.l The following regulations shall apply in all parts of
said district: '
a. No building or structure shall hereafter be located with-
in the district closer than fifty {50) feet from the
centerline of said highways, except where said highways
are classified by the County as a Federal Aid Secondary
road, the minimum building setback requirement shall be
fifty-five (55) feet from the centerline of said road.
b. Building Site Area: The building site area shall be the
same as provided in the County Subdivision Ordinance.
c. Na signs, billboards or advertising displays shall be
erected within the district except signs advertising only
the sale or lease of land upon which sign is placed, or
the products gxown ox raised upon such property, and
~, established or permitted uses on such property.
d. Off-street Parking: Off--street parking area shall be
as required by the Planning Commission.
4.2 Signs, billboards ax advertising displays, except as
provided in Section 3.2 shall be permitted only to permitted uses,
not to exceed forty (40) square feet in area and shall be pertinent

to the permitted uses.
SECTION 5. Use Permits:
The application and procedure for t3se Permits shall be as
ovided by the Butte Gounty Zoning Enabling Ordinance.
SECTION 6. All uses of land within the district not specifical
thorized and permitted are prohibited.
SECTION 7. The penalties far any violation of the zoning here-
by imposed within the district shall be as provided in the Zoning
Enabling Ordinance. In compliance with the provision of the
Zoning Enabling Ordinance, this Ordinance shall from and after its
effective date become a supplement to and part of the Zoning Enab-.
ling Ordinance.
SECTION 8. This Ordinance shall take effect immediately upon
its passage and before the expiration of fifteen {15) days after
its passage shall be published once with the names of the members
voting far and against in the CTiICO ENTERPRISE
a newspaper published in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County
