RESOLUTION ABANDONING A PUBLIC SERVICE EASEMENT
This matter came on regularly for hearing before the
Board of Supervisors of the County of Butte, State of California,
on March 12 , 1985, in the Board Chambers, Butte County
Administration Building, Oroville, California, and it appearing to
said Board that a Notice of Time and Place of Hearing of said
Abandonment was duly and regularly given as required by law, and
testimony and evidence, both oral and documentary, having been
produced at said hearing, from which said Board now finds that the
hereinafter described Public Service Easement is unnecessary for
present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public service easement situated in the
County of Butte, State of California, as hereinafter more parti-
cularly described is hereby abandoned.
2. That the description of said public service easement
so abandoned is situated in the County of Butte, State of California,
and more particularly described as follows:
ACCESS EASEMENT - Waters Sub. No. 1
A.P. - - 0 to
Being that certain 20-foot access easement lying
taithin a portion of Section 9, T22N, R1E, M.D.M.
as shown on the Map of Waters Subdivision Unit No.
1 (Lots 5 through 9) recorded in Book 35, Maps of
Record, at Page 42, County of Butte, State of
California, more particularly described as follows:
Being that certain 20--foot access easement lying
southwesterly of and contiguous to the northeasterly
lot line of Lots 5 through 9 of said Waters Subdivision,
bounded on the northwest by the southerly right of way
line of that certain street known as Tonea Way, and
bounded on the southeast by the southerly subdivision
line of said Waters Subdivision.
Said Map showing the access easement t0 be abandoned
is on file in the Office of Butte County Department
of Public Works, 7 County Center Drive, Oroville, ~~""` 80~~

3. That the Clerk of this Board shall cause a certified
copy of this Resolution, with the seal of the Board of Supervisors
of the County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of Supervisors:
this 12th day of March 1985, by the following vote.
AYES: Supervisors Dolan, McInturf, McLaughlin, Wheeler and Chairman Hinton
