RESOLUTTON ESTABLISHING COUNTY SERVICE AREA N0. 90 -
SOUTHGATE ACRES SUBDIVISION (STORM DRAINAGE AND
FIRE HYDRANT MAINTENANCE) AND COUNTY SERVICE AREA
N0. 93 - PLEASANT OAK SUBDIVISION (STREET LIGHTING
AND STORM DRAINAGE)
WHEREAS, heretofore on the 12th day of February, 1985, the
Board of Supervisors of the County of Butte, State of California,
adopted and passed a resolution of notice of intention to establish
County Service Areas No. 90 and 93; and
WHEREAS, said resolution fixed the 19th day of March, 1985,
at 10:15 a.m. in the Board of Supervisors' Room of the County Admin-
istration Center in the City of Oroville, State of California, as the
time and place for the public hearing on the establishment of said
area and the assessment of a per parcel service charge, which
hearing was continued until April 2, 1985; and
WHEREAS, said Board, at both times and places, proceeded
l-' to hear arguments both for and against the establishment of said
area and the assessment of a service charge; and
WHEREAS, no written protest against the establishment
thereof was filed in accordance with Section 25210.17 of the
Government Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors
of the County of Butte, State of California, as follows:
1. Said Board hereby finds and determined that the proceed-
ings herein were conducted pursuant to Section 25210.1 et sec{. of the
Government Code and that publication and notices were given pursuant
to that; said Board finds and determines that the services described
in the resolution of intention are extended county services.
2. The Board hereby determines to establish said county
service areas.
3. The boundaries of said county service areas are hereby
finally determined and established to be the same as are shown in
Exhibits A and B attached hereto and incorporated herein by reference
and made a paxt hereof by this resolution.
4. The names of said service areas are County Service Area
No. 90 - Southgate Acres Subdivision (Storm Drainage and Fire Hydrant
Aaintenance) and County Service Area No. 93 - Pleasant Oak Subdivision
{Street Lighting and Storm Drainage).
5. The types of extended county service to be provided
within said areas is storm drainage and fire hydrant maintenance in
County Service Area No. 90 and street lighting and storm drainage in
County Service Area No. 93.
6. In accordance with the provisions of the Butte County
Code Sections 21.85 through 21.90, a per-parcel service charge shall
be levied against all the parcels within County Service Areas No. 90
and 93. Each parcel shall be assessed an individual service charge
based upon benefit. Said charge shall appear as a separate item on
the tax bill and shall be collected at the same time and in the same
manner as ordinary County ad valorem taxes are collected and shall be
subject to the same penalties and the same procedure and sale in the
case of delinquency as provided for such taxes. A11 laws applicable
to the levy, collection and enforcement of County ad valorem taxes
shall be'applicable to such charge, except that if real property to
which such charge relates has been transferred or conveyed to a bona
fide purchaser for value, or if a lien of a bona fide encumberer for
value has been created and attached thereon, prior to the date on
which the first installment of said taxes would become delinquent,
then the charge confirmed pursuant to this resolution shall not result
in a lien against said zeal property but instead shall be transferred
to the unsecured roll for collection.
7. Said county service areas are established for all pur-
poses subject only to compliance with the requirements of Chapter 3,
Part I, Division II, Title V of the Government Code and subject to the
provisions of Article 2.5, chapter 2.2, Paxt I, Division II, Title III
of the Government Code of the State of California.
