RESOLUTION OF THE, BOARD OF SUPERVISORS
AMENDING RESOLUTION N0. 81-182
WHEREAS, on August 4, 1981 the Butte County Board of Supervisors adopted
Resolution No. 81-182 which Resolution adopted Environmental Review Guidelines; and
WHEREAS, it is necessary to revise the Environmental Review Guidelines
relative to the preparation of the Environmental Impact Reports.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that Section 4,
Part K of Exhibit A to Resolution No. 81-182 be amended to read as follows:
K. If it is determined that the project may have a significant effect
on the environment and an EIR is required, the applicant will be notified in writing
that his application cannot be acted upon until the EIR is prepared and reviewed.
If the applicant wishes to pursue his project, the environmental review coordinator
(ERC) shall prepare or shall contract to have the EIR prepared.
BE IT FURTHER RESOLVED by the Board of Supervisors that Exhibit "A"
Page 13 to Resolution No. 81-182 titled "Procedures for Determination of Costs
for Preparation of Environmental Impact Reports" is hereby amended to read:
RESPONSIBILITY FOR COSTS OF
PREPARATION AND ADMTNTSTRATION
OF ENVIRONMENTAL IMPACT REPORTS
Private Projects: The applicant shall pay all costs incurred for
administration and preparation of an environmental impact report up to and including
the filing of all Notices of Determination related to the project.
The costs for environmental impact report preparation and administration
shall include public hearing attendance, printing costs, consultant's fees, and any
other relevant expenses incurred by the County. The costs of County personnel time
will be twice the hourly salary rate of County employees involved in the preparation
and administration of the environmental impact report.
Prior to an agreement being entered into for the preparation of a draft
EIR by the County and a consultant, the applicant shall deposit the total amount of
the compensation of the consultant.
A deposit for County employees' time will be estimated for each
application. If the actual costs for County employees' time are less than the
amount deposited by the applicant, the remaining amount of money shall be re-
turned. If the costs are greater than the estimate, the applicant shall pay
the additional amounts exceeding $200.00 within 10 days of notice by the environ-
mental review coordinator by registered mail. In the event that payment is not
received for the additional amounts in excess of $200.00, the environmental review
coerdinator will immediately cease processing the EIR and notify the Collection
Agency.
PASSED AND ADOPTED by the Butte County Board of Supervisors on the 18th
day of June 1985, by the following vote:
AYES: Supervisors Dolan, McInturf, Wheeler and Vice Chairman McLaughlin
NOES: None
ABSENT: Chairman Fulton
NOT VOTING: None
