Home My WebLink About85-149RESOLUTION ESTABLISHING COUNTY SERVICE AREA N0. 95 (COPLEY ACRES UNIT N0 .' 3 - STORM DRAINAGE) WHEREAS, heretofore on the 6th day of August, 1985, the Board of Supervisors of the County of Butte, State of California, adopted and passed a resolution of notice of intention to establish. a county service area to be entitled County Service Area No. 95 (Copley Acres Unit No. 3 - Storm Drainage); and WHEREAS, said resolution fixed the 17th day of September, 1985, at 10:30 a.m. of said day in the Board of Supervisors' Room of the County Administration Center in the City of Oroville, State of California, as the time and place for the public hearing on the establishment of said area and the assessment of a per-parcel service charge; and WHEREAS, said Board at said time and place proceeded to hear arguments both for and against the establishment of said area and the assessment of a service charge; and WHEREAS, no written pxotests against the establishment thereof were filed in accoxdance with Section 25210.17 of the Government Code. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. Said Board hereby finds and determines that the proceedings herein wexe conducted pursuant to Section 25210.1. et seq. of the Government Code and that publication and notices were given pursuant to that; said Board finds and determines that the services descxibed in the resolution of intention are extended county services. 2. The Board hereby determines to establish said county service area. 3. The boundaries of said county service area axe hereby finally determined and established to be the same as axe shown in Exhibit A attached hereto and incorporated herein by reference and made a part hereof by this resolution. 4. The name of said service area is County Service Axea No. 95 (Copley.Acres.-Unit No. 3 - Storm Drainage). 5. The type of extended county sexvice to be provided within said area is stoxm dxainage improvement maintenance. 6. In accordance with the provisions of the Butte County Code Sections 21.85 through 21.90, a per-parcel service charge shall be levied against all the parcels within County Service Area No. 95. Each parcel shall be assessed an individual. service charge based upon benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary County ad valorem taxes are collected. and shall be subject to the same penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem taxes shall be applicable to such charge, except that if real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumberer for value has been created and attached thereon, prior to the date on which the first installment of said taxes would become delinquent, then the charg confirmed pursuant to this reso- lution shall not result in a lien against said real property but instead shall be transferred to the unsecured roll for collection. 7. Said county service area is established for all purposes subject only to compliance with the requirements of Chap- ter 8, Part I, Division II, Title V of the Government Code and subject to the provisions of Axticle 2.5, Chapter 2.2, Part I, Division II, Title III of. the Government Code of the State of California.
