HomeMy WebLinkAbout85-159RETURN TQ PUBLIG W~R~ DEPTH j. s ~* r :~~ ~~~ BOARD Off' SUPERVISORS ~~ : ~ ~ *~ CO{JIVTY QF BUTTE, STATE OF CALIFORNL4 ,~ + ~ ,~ ~~~ ~ _~' ' ReSOlufion No. 85-159 RESOLUTTON MAKING APPLICATTON TO LOCAL AGENCY FORMATION COMMISSION REGARDING DISSOLUTION OF COUNTY SERVICE AREA N0. 43 WHEREAS, the Board of Supervisors of the County of Butte intends to consider a pro- posal for dissolution of a county service area; and WHEREAS, no proceeding for the dissolution of such a service area shall be instituted by this Board or required by its members until approval of the Local Agency Formation Commission is first obtained. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Butte County Board of Supervisors as follows: 1. Application and a pz q.p~osal for dissolution of County Service Area No. 43 is here- by made to the Butte County Local Agency Formation Commission in accordance with the District Reorganization Act, §5b000 et.seq. The exterior boundaries of the service area are described in Exhibit "A" attached hereto and made a part hereof by this reference. 2. Dissolution of said service area is proposed under the County Service Area Law. The type of extended service proposed to be dissolved is the study, design, construction, maintenance and operation of a sanitary sewer service. 3. Pursuant to revenue and Taxation Code, the funds held in trust shall be used for capital expenditure for a water tender for the Butte County F?ire Department Palermo Station. 4. The reason for the proposed dissolution is that the need for the study, design,::. construction, maintenance and operation of a sanitary sewer service no longer exists. 5. The Clerk of the Board is authorized and directed to file a certified copy of this resolution with the Executive Officer of the Butte County Local Agency Formation Commission.
