RESOLUTION AUTHORIZING ACCEPTANCE OF HIGHWAY EASEMENT
FROM SOUTHERN PACIFIC TRANSPORTATION COMPANY RE NELSON
ROAD CROSSING N0. C-171.5
BE IT RESOLVED by the Board o£ Supervisors of the County o£ Butte, State of
California, as follows:
1. That said Board hereby accepts highway easement for Nelson Road from
Southern Pacific Transportation Company.
2. The Chairman of this Board is hereby authorized to execute, on behalf
of the County of Butte, said easement.
3. That a certified copy of this Resolution be attached by the Clerk of said
Board to said easement and the required copies thereof be forwarded to the
Southern Pacific Transportation Company.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State
of California, this ].7th day of December 1985 by the following
vote:
AYES: Supervisors Dolan, McInturf, McLaughlin, Wheeler and Chairman Fulton
NOES: None
ABSENT: None
NOT VOTING: None

SOUTHERN PACIFIC TRANSPORTATION COMPANY,
a Delaware corporation,
herein called "Railroad", and
COUNTY OF BUTTE, apolitical subdivision of ,the State of :California, address
herein called "Grantee";

1. That Railroad hereby grants to Grantee the right to construct, reconstruct, maintain and use a street or highway,
hereinafter termed "highway", upon and across the real property described on the attached Exhibit "A".
2. The rights herein granted are expressly limited vertically and shall not extend beyond a plane parallel with and
twenty E20) feet above the roadway surface of the highway as ot•iginally constructed, except that lighting fixtut•es and simi-
lar highway appurtenances may extend above said plane, plovided that any such facilities will be removed or rearranged
within thirty (30) days after notification from Railroad ;that such.facilities interfere with Railroad's intended use of the
space above said plane.
3. This grant is subject and subordinate to the prior right of Railroad, its successors and assigns, to use all the pro-
perty described in the performance of its duty as a common carrier, and there is reserved unto Railroad, its suecessors and
assigns, the right to construct, reconstruct, maintain. use and remove existing and future transportation, communication,
power and pipeline facilities in, upon, over, under, across or along said property. In the event Railroad trackage facilities
are removed from said property, Railroad shall not be obligated to make any change in the grade of said .highway, nor
shalt such removal affect Railroad's title to the underlying property.
This grant is subject to all licenses, leases, easements, restrictions, conditions, covenants, encumbrances, liens and
claims of title which may affect said property, and the word "grant" shall not be construed as a covenant against the
existence thereof.

A strip of land. 60 feet wide, situated in the Town of Nelson

{unincorporated), County o€ Butte, State of California, lying egually,
30 feet on each side of the following described center line:
Beginning at a paint in the southwesterly line of land {238
feet wide) of Southern Pacific Transportation Company, said point
being distant 110 feet southwesterly; measured at right angles from
the original located center line of Southern Pacific Transportation
Company's main track {Dunsmuir - Roseville) at Railroad Engineer
Station 1613+17; thence northeasterly, at right angles from said
southwesterly line, 238 feet to the northeasterly line of said
Company's land.
The side lines of the above described 60 foot wide strip of
land terminate in said northeasterly and southwesterly lines.
