RESOLUTION OF THE BUTTE COUNTY BOARD OP SUPERVISORS REQUESTING
STATE LEGISLATION TO ALLOW BUTTE COUNTY TO TRANSFER OWNERSHIP
OF A PORTION OF LINDO CHANNEL (BIDWELL STATE PARK) TO THE CITY OF CHICO
WHEREAS, in 1908, Annie E. K. Bidwell deeded to the State of California
all of Lindo Channel between Bidwell Park and the Sacramento River; and
WHEREAS, in 1950 the State of California deeded all of Lindo Channel
to the County of Butte "for the establishment, improvement and conduct of a public
park for the use of the people of the state;" and
WHEREAS, said deed to the County of Butte prohibits the granting of
Lindo Channel to any individual firm or corporation; and
WHEREAS, in the intervening years since Lindo Channel was deeded to
the County of Butte, the city limits of the City of Chico have surrounded portions
of Lindo Channel; and
WHEREAS, the Butte County Local Agency Formation Commission (LAFCo)
has approved a Sphere of Influence for the City of Chico, which Sphere of Influence
includes that portion of Lindo Channel between Bidwell Park and State Highway
Route 32; and
WHEREAS, the City of Chico and the County of Butte have agreed that
the City of Chico should acquire and assume responsibility for the portion of
Lindo Channel within the city's Sphere of Influence; and
WHEREAS, California State Senator Jim Nielsen has indicated his
willingness to introduce legislation to allow the County of Butte to transfer
the portions of Lindo Channel within the city's Sphere of Influence to the City
of Chico.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY
OF BUTTE AS FOLLOWS:
1. That California State Senator Jim Nielsen is hereby requested to
introduce legislation to authorize the County of Butte to deed
to the City of Chico that portion of Lindo Channel described and
delineated in Exhibits "A" and "B", attached hereto and by this
reference incorporated herein.
PASSED AND ADOPTED this 19th day of February, 1986, by the fallowing
vote:
AYES: Supervisors Dolan, McInturf, Fulton, Wheeler and
Chairman McLaughlin

LTNDO CHANNEL ACQUISITION N0. 1
All that certain real property situate in the County of Butte,
State of California, described as follows:
That portion of the green belt areas along Lindo Channel. granted
to said County of Butte by the State of California by ChapCer 73
of the Statutes of 1950, as recorded in Book 536 of Official Records
at pages 274 and 275 in the Office pf the Butte County Rsc.arder;
also being that portion of the green belt areas along Lindo Ghannel
which said County of Butte expressly reserved to itself all right,
title, and interest in that document entitled "Agreement and Transfer
of Rights far Portion of Bidwell River Park", said document being
recorded in Book 2431 of Official Records at pages 585 through 621
in the Office of 'the Butte County Recorder; more particularly
described as follows:
All of that strip of land of varying widths including both banks in
the channel of Lindo Channel, otherwise called Sandy Gulch, bounded
by the westerly line of the Park deeded by Annie E. K. Bidwell to
the City of Chico on July 10, 1905, and the southwesterly line of
Nord Avenue, also known as California State Highway Route 32.
Containing 110 acres, more or less.
