HomeMy WebLinkAbout86-028 r ^ ,, Resolufion No. 86-28 WHEREAS, the Butte County Board of Supervisors has previously adopted Resolution No. 85-186 opposing the Cohasset Road Annexation District No. 23 as proposed; and WHEREAS, the Local Agency Formation Commission, at its regular meeting of January 1986, denied the annexation project without prejudice and recommended the Cohasset Road Annexation District No. 23 be included in the North Valley Plaza Mall Annexation Project which is contiguous and, therefore, represents cumulative effects in the area; and WHEREAS, the Local Agency Formation .Commission included the Cohasset Road Annexation District No. 23 Project in the North Valley Plaza Mall environ- mental impact report to enable consideration of the Cohasset Road Annexation District No. 23 Project and the North Valley Plaza Mall Annexation Project at a later date; and WHEREAS, the Local Agency Formation Commission, at its regular meeting in February 1986, approved the Cohasset Road Annexation District No. 23 without consideration of its previous vote on environmental considerations and without notice to Butte County. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Super- visors recommends to the Local Agency Formation Commission, during its delibera- tions at the regular meeting of March 6, 1986, that the Commission consider: 1. The cumulative impact nature of the proposed annexa- tion of the Cohasset Road Annexation District No. ~BO~A'RD aF SUP;ERVIS~RS ,; CQLlNTY OF EiC.iTTE, _STAT,E pF C,4LIFORNIA 23, which is contiguous to the proposed North Valley Plaza Mall Project. 2. That the Local Agency Formation Commission set out a clear record of the environmental review actions, keeping in mind that in January 1986 the Commission recommended inclusion of this project in the North Valley Plaza Mall environmental impact report. RESOWTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS REGARDING LOCAL AGENCY FORMATION CONMISSION ACTIONS ON THE CITY OF CHICO COHASSET ROAD ANNElWTION DISTRICT NO. 23 PROJECT -2- 3. That the Local Agency Formation Commission consider that the 5hakey's and Skipper's businesses located within the Cohasset Road Annexation District No. 23 are already served by sewers and, therefore, any delay in the annexation does not affect the operation of these commercial enterprises. 4. That the Local Agency Formation Commission view the Cohasset Road Annexation District No. 23 from the perspectives of its own policy which states: "A proposal must not represent an attempt by the city to annex only revenue producing property," and "Within the proposal there must be a cost vs. benefit justification for the proposed formation," and view these policies in the context of cumulative effects in the area. 5. The Butte County Board of Supervisors continues to support the reasons against this project as set forth in their Resolution 85-186 previously sent to the Local Agency Formation Commission.
