HomeMy WebLinkAbout86-039-.W. ik _, ,_ ~; ~' E - ,'~, v ~; BOARD OF SUPERVISORS *~ COUNTY OF BUTTE,: STATE OF CALIFORNIA .; N ~ .,. ,, * C """~ Resolufion No. 86-39 co~N~ RESOLUTION ADOPTING AN AMENDMENT TO THE CHICO AREA LAND USE MAP AND POLICIES OF THE LAND USE ELEMENT OF THE BUTTE COUNTY GENERAL PLAN WHEREAS, the Butte County Planning Commission pursuant to Govern- ment Code Section 65350 et seq. initiated General Plan Amendments, as shown on Exhibits B-1 through B-9 attached hereto, to the Chico Area Land Use Map of the Land Use Element; and WHEREAS, the proposed General Plan Amendments have been studied and reviewed by the Butte County Planning Commission and a public hearing held pursuant to law, at which time all interested persons were heard; and WHEREAS, the Butte County Planning Commission finds the proposed amendment (Exhibits B-1 through B-9) together with the other applicable elements of the Butte County General Plan comprise an overall internally consistent whole; and WHEREAS, the proposed urban reserve policy statements implement Land Use Element policies regarding orderly development and Circulation Element policies regarding encroachments onto urban arterials; and WHEREAS, the Butte County Board of Supervisors has reviewed and considered the contents of the environmental review study checklists (Exhibit B-10) prepared on the proposed General Plan Amendment including potentially significant impacts, and findings described within the documents pursuant to the California Environmental Quality Act; and WHEREAS, the Board of Supervisors has considered the Planning Commission's recommendations; and WHEREAS, the Board finds that the proposed land use map amendments and urban reserve policy statement are consistent with the elements of the Butte County General Plan. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The General Plan Amendment from Agricultural-Residential to Industrial (4140); Low Density Residential to Commercial (4125); Low Density Residential to Agricultural-Residential (4126); Medium Density Residential to High Density Residential (418}; Medium Density Residential to Low Density Residential 14122); Commercial to Commercial with Urban Reserve (4120); Commercial to Low Density Residential (421); Commercial to Industrial (i~38); Commercial and Tndustrial to Low Density Residential (4k42); Industrial to High Density Residential (4630); Industrial to Agricultural-Residential (4136); Industrial to Public (4644); Public to Low Density Residential (437 and 4641); Public to Industrial/Agricultural-Residential (4635). (See Exhibits B-1 through B-8.) 2. The General Plan text amendment to include urban reserve policies applicable to Area 20 (see Exhibit B-9). BE TT FURTHER RESOLVED, that the Board of Supervisors finds that the initial study and Negative Declaration prepared for the General Plan Amendments are adequate for this project for compliance with the California Environmental Quality Act. BE IT FURTHER RESOLVED, that pursuant to Government Code Section 65359 that the General Plan be endorsed to show that the above amendments have been approved by this Board. BE IT FURTHER RESOLVED, pursuant to Government Code Section 65357, a copy of this resolution be transmitted to the City Councils of the Cities of Butte County. Approximately 50 acres now in orchard are slated for cot~mercial development. In order to imglement the General Plan's goals and policies regarding orderly growth and circulation, the following policies apply to all development proposals. I. All properties on th?northeast side of Highway 32 between Lindo Channel and 6b0 ft. north of East Eighth shall be managed as an urban reserve. 2. Permitted uses under the urban reserve include 1 d.u./10 acres, agricultural operations and accessory uses permitted by the A-10 zoning district. 3. Any proposal to rainve the urban reserve designation shall be coordinated with extension of community water, sewer, drainage and fire hydrants. 4. Circulation: a. Parcels 42-14-77, -78 shall take access from Lindo Avenue. b. Parcels 42-14-98, -103, -104, shall be allowed one access each onto Highway 32. c, Along Highway 32, a l ft. no-access strip shall be deeded to Butte County, with the exception of approved encroachments. d. Subdivision of the parcels shall be coordinated with construction of a frontage road between approved access points. e. Development shall contribute its fair share (as determined by the Airector of Public Works) towards improvement of the Highway. 32/Sacramento Avenue intersection. Improvement includes widening, realignment, or signalization. 5. All structures shall be located a minimum of 25 ft. from the northeast right-of-way of Highway 32. 6. Lighting shall be shielded from Highway 32. 7. The following high traffic generators are specifically prohibited in this area: a. Gasoline stations. b. Fast-food operations (does not include delicatessens, cafes or restaurants). c. Dry cleaners. d. Banks. e. Coin laundries. 8. At the recommendation~of the Chica Area Land Else Committee, the Butte County Planning Commission Initiated numerous General Plan Amendments. Each area is identified by number on the attached exhibits. The amendment achieves a number of purposes: ~ reflects existing land usei ~ corrects mapping errarsi -6- t r * brings the City's and County's plans into conformity; ~ shifts development potential to sites served by sanitary sewer. The initial study will focus on the change in development-related impacts resulting from the pro~ect« DISCUSSION OF ENVIRONMENTAL EVALUATION 1g: The project is within Chico 's urban area. 2a: Primary sources of air pollution include trafflc,~ ag operations and industry. The project will reduce future traffic generation through a reduction in housing units, acreage devoted to industrial and commercial land uses. 3b,c: Drainage and sewage disposal lines will eventually be extended throughout the entire urban area. Calculations for layout, pipe size and depth have been based on Chico 's land use designations. The General Plan Amendment helps to ensure that future development will not tax the drainage system. 31: California Water Service provides water to mast of these properties. 5d: Site-specific impacts to riparian vegetation are possible. Appropriate review and mitigation measures will be applied at the time of rezone and land division. 6a: The General Plan Amendment will not have a noticeable effect on area noise levels. 8= The focus of the General Plan Amendment is land use. Where services are available, densities have been increased (#8, #30 ). Densities have been decreased at the community's request <#26 ). Mast General Plan Amendments are to reflect existing land use (#21, #22, #25, #3b, #37, #41, #42, #44 ). An urban reserve has been proposed for Area #2i). Specific policies will be developed to address infrastructure limitations and traffic constraints. Area #35 proposed to correct a mapping error. The City of Chico has requested the changes on Areas #38 and #40. 11,12: Development potential will be shifted to~sites where Infrastructure is available. 13: Future traffic will be reduced through elimination of 19 acres of commercial/industrial and 98 potential housing units. 14: Public service demands will be minimized. 16d,e: Sewage and drainage facilities are planned to be installed throughout the entire urban area independent of this project. -7- •
