W '. ~ ,:~~ ~~~ `° ~""°°{S`t.• ~ Resolution No yr r 85-95 9r~~ RESOLUTION AMENDING RESOLUTION 82-1 AND 52-2 OF THE BUTTE COUNTY AIR POLLUTION CONTROL DISTRICT RULES AND REGULATIONS WHEREAS, The County of Butte has previously imposed a permit fee for all permits issued by the Butte County Air Pollution Control District for burning germits and permits for stationary air pollution sources; and WHEREAS, the permit fee is predicated on recovering reasonable costs incurred by the District in performing permit evaluation, surveillance, pry- and post-site inspections, and enforcement of the Butte County Air Pollution Control District's Rules and Regulations; and WHEREAS, the existing permit fee schedule is no longer appropriate with respect to the monitoring of stationary air pollution sources as required by the State of California. NOW, THEREFORE BE IT RESOLVED that Resolution 82-1 and 82-1 which established the current fee schedule of the Butte County Air Pollution Control District's Rules and Regulations is amended as follows: RULE 501 PERMIT FEES is amended to read as follows: RULE 501 PERMIT FEES Each applicant for a permit required by Regulation IV shall pay the Permit to Operate annual fee and pay an additional fee as specified in the following Emission Fee Schedule. These fees have been determined by the Air Pollution Control Board to not exceed the estimated cost of issuance, services rendered, surveillance, evaluation and inspections pertaining to such permits. The schedule fees shall not be returnable. All fees collected shall be deposited in khe Treasury of the Air Pollution Control District. Permit to Operate Annual Fee S 50.00 Emission Fees (Cost per Ton) Particulate Matter (PM) S 3.00 Carbon Monoxide {CO) S 3.00 Oxides of Nitrogen ENOX). - - - $ 3.00 Oxides of Sulfur (SOx}. S 3.00 Total Organic Compounds (IOC} _ $ 3.00 -2- Toxic or Hazardous Pollutants Any Pollutant designated by a state or federal agency as a toxic or hazardous pollutant shall pay an emission fee of. $ 10.00 Other Pollutants Other Pollutants not designated in the above table and not classified as hazardous or toxic shall gay an emission fee based on the severity of such emissions with regards to air quality, as determined by the Cantral Board. Said fees shall not exceed. $ 10.00 Transfer of Ownership Fee $ 30.00 Authority to Construct Fee $100.00 Time Expenditure: 0 to 1 hour _ no additional fee 1 to 3 hours. $100.00 Greater than 3 hours. $ 30.00 per hour RULE 507 BURNING PERMIT FEES is amended to read as follows: RULE 507 BURNING PERMIT FEES The following charges shall be made by the Butte County Air Pollution Control District for burning permits. Each Air Pollution Control Burning Permit, for which the applicable fee has been paid, shall be valid far twelve {12) months from the date of issuance. Agricultural Burning (Burning conducted under Rule 302B) Land Clearing (Burning conducted under Rule 302D) Right-of -Nay, Levee, Ditch (Burning conducted under Rule 302C) Base Fee _ $ 15.00 0 - 99 acres no additional fee Greater than 99 acres. 51.50 per 100 acres and incr ements thereof Fire Hazard Reduction and Employee Instruction (Burning conducted under Rule 302.E.1 and 302F). $ 50.00 -3- PASSED AND ADOPTED by the Butte County Board of Superviiors this 22nd day of July, 1986, by the following vote: AYES: Supervisors Dolan, Fulton and Wheeler NOES: Supervisor Mclnturf and Chairman McLaughlin ABSENT: None NOT VOTING: None - ~~1.
