APPROVING THE STANDARD AGREEMENT WITH THE
CALIFORNIA ARTS COUNCIL FOR LEVEL I FUNDS
WHEREAS, the California Arts Council and the California
State Legislature have established the State%Local Partnership Program
designed to encourage local cultural planning and decision making
and to reach previously underserved constituents; and
WHEREAS, an application for the Level I grant program has
been submitted by the County of Butte; and
WHEREAS, the California Arts Council has offered the Butte
County Board of Supervisors participation in the Level I California
Arts Council Grant Program should the Board of Supervisors approve
the standard agreement acknowledging receipt of $17,000 in grant funds
requiring a match of $4,000.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board
of Supervisors does hereby authorize the Chairman to sign the standard
agreement accepting these grant funds from the California Arts Council
on beha]f of the Butte County Arts Commission.

1. The Contractor agrees to indemnify, defend and save harmless the State, its officers, agents ~- •
and employees from any and all claims <tnd losses accruing or resulting to any and all contractors,
subcontractors, materialmen, laborers and any other person, firm or corporation furnishing or
supplying «-orle, services, materials or supplies in connection with the performance of this contract,
and from any and all claims and losses accruing or resulting to any person, firrn ar corporation
.rho may be injured or damaged by the Contractor in the performance of this contract.
2. The Contractor, and the agents and employees of Contractor, in the performance of this
agreement, shall act in an independent capacity and not as officers ar employees ar agents of
State of California.
3. The state may terminate this agreement and be relieved of .the payment of any consideration
to Contractor should Contractor fail to perform the covenants herein contained at t`1e time and
in the manner herein provided. In the event of such termination the State may proceed with the
.cork in any manner deemed proper by the State. The cast to the State shall 1}e deductccf from
any sum due the Contractor under this agreement, and the balance, if any, shall be paid the
Contractor upon demand.

either in whole or in part.
S. Tune is the essence of this agreement.
6. No alteration or variation of the terms of this contract shall be valid unless made in writing
and signed by the parties hereto, and na oral understanding or agreement not incorporated herein,
shall be binding an any of the parties hereto.
;. The consideration to be paid Contractor, as provided herein, shall be in compensation for
all of Contractor's expenses incurred in the performance hereof, including travel and per diem,
unless othen~~ise expressly so provided.
SCHEDULE OF AGREEMENT
State--Local Partnership Program
1,986-8'7 Level One
Between California Arts council (hereinafter called CAC) and the
aforenamed Contractor (hereinafter called Contractor and/or
Grantee} for participation in the CAC's State-Local Partnership
for Fiscal Year 1986-87.
The State-Local Partnership Program provides support to local
arts organizations .throughout California for administrative
support and project support. The objectives for this program
include: 1) Providing for the growth and development of those
Local Partners that have been designated by local governments to
participate in the State-Local Partnership Program;
2) Increasing private and public funding for the arts; 3)
Increasing cultural participation among underserved populations
in the state.
1. Contractor does hereby agree to conduct and carry out in
full the activities and/or project described in the proposal
narrative, Project Budget and Project Summary attached
hereto and incorporated herein as part of this contract.
Contractor may request to amend the project in writing to
the CAC Program Manager but shall not implement any such
changes until receipt of written approval from CAC.
2. In consideration for the satisfactory performance of the
services specified •~abo~e--,CAC hereby agrees to pay
Contractor a sum not to exceed the total amount encumbered
as shown on the Standard Agreement, for items as listed on
the Project Budget, attached hereto and incorporated herein
as part of this agreement. Contractor shall match in cash
(or in-kind if allowable) a dollar amount for each kind of
funding as stipulated in the State-Local Partnership Program
Guidelines:
a. For Level One an unmatched payment of $13,000 will
be made in advance upon receipt of an invoice
submitted to the CAC.
b. Also for Level One a payment of $~,OOO, called the
Incentive Grant, shall be made in arrears, for
services rendered and/or .goods or services
purchased, upon receipt-of an~invoice submitted to
_ the ~ CAC not more often than monthly to which is
attached- documentary evidence of grant and match
expenditures upon which the claim for payment is:
based.

c. Level One Incentive Grant funds must be matched
dollar for dollar unless Contractor qualifies for
use of hard in--kind goods or services as partial
match for up to 50~ of the required match and has
received approval from the'CAC. Contractor shall
submit proof of such goods or services as
specified in the State Local Program Invoicing
Instructions.
d. Budget changes shall be allowed: within the Salary
division but may not increase or decrease a
specified line item by more than 25~, Within the
Operational division the same shall apply. The
Contractor must request in writing to: 1) increase
any item more than 25~; 2} move dollars between
Salary and Operational divisions; or, 3) create
new line items. Contractor shall not implement
any such requested changes until receipt of
written permission from the CAC.
The CAC shall disallow payment of any claim which
would result in payment by CAC of a sum in excess
of the total obligation of the CAC as specified on
the contract.
-~--. e. Contractor hereby agrees to report to CAC,
regarding operating and/or financial information
upon such forms as CAC may require. Failure of
Contractor to fully, accurately and timely comply
with CAC~s reporting and requisitioning
requirements shall result in disallowance of
payments by CAC.

A Summary of Receipts Form (Form A2) and List of
Receipts Form (Form B) on which each grant and
matching expenditure is entered and an invoice
sheet must accompany each invoice. The Final
Financial Statement (Form C2} mush be~submitted
with the last invoice in addition to the Form A2
and B.
Samples of Forms required are attached hereto and'
included as.part~of~this contract.

3. Partners shall serve as the liaison between the local arts
community and the CAC. This includes arranging
consultations- for CAC grants program staff and prospective
applicants when scheduled in the Partner's county/city.
Consultation arrangements include: identification and
outreach to sign up prospective applicants for appointments,
telephone contact and confirmation of appointments, facility
arrangements, publicity, and/or other requests made by CAC
staff.
4. If travel expenses are included in the approved budget, the
State rules governing such expenses shall apply' to the
Contractor. All travel must be within the State of
California to be reimbursable.
5. The Non-Discrimination Clause, General California Arts
Council Requirements are attached hereto and are hereby made
a part of this contract. The Contractor is responsible for
knowing and adhereing to the requirements of these
attachments and the Program Access regulations (Section 504
of the Rehabilitation Act of 1973 and the State of
California Government Code 1].135-].1.1.39.5) .
6. Mention of the California Arts Council, State-Local
Partnership Program should be made in any printed, visual or
recorded matter, or in any exhibition, display or
performance, which describes or is prepared in connection
with, or results in whole`®r i~r~ga:rt from the CAC grants.
Copies of printed matter containing such mention should be
sent to the CAC. Any documents containing such mention
shall specify that any findings, opinion, or conclusions
contained therein are not necessarily those of the CAC.
7. This grant award becomes null and void if signed contracts
-are not returned within sixty (60) days of receipt from CAG
for signature.
8. This grant shall not be deemed accepted, valid or binding on
the part of the State unless approved by the Departments of
Finance and/or General Services of the State of California,
whexe their approval~is required. ~.
NONDISCRIMINATION CLAUSE
(OCP - 1) -
l.. .During .the-performance of this contract, contractor and its
subcontractors shall not unlawfully discriminate against any
employee or applicant for employment because of race,
religion, color, national origin, ancestry, physical
handicap, medical condition, marital status, age (over 40)
or sex. Contractors and subcontractors shall insure that the
evaluation and treatment of their employees and applicants
.for employment are free of such discrimination. Contractors
and subcontractors shall comply with the provisions of-the
Fair Employment and Housing Act (Government .Code, Section
12900 et seg.) and the applicable regulations promulgated
thereunder (California Administrative Code, Title 2, Section
7285.0 et seg.). The applicable regulations of the Fair
Employment and Housing Commission implementing Government
Code, Section 12990, set forth in Chapter 5 of Division ~ of
Title 2 of the California Administrative Code are
incorporated into this contract by reference and made a part
hereof as if set forth in full. Contractor and its
subcontractors shall give written notice of their
obligations under this clause to labor organizations with
which they have a collective bargaining or other agreement,

compliance provisions of this clause in all subcontracts to
perform work under the contract.

accomplish your objectives for the upcoming fiscal year (see directions).
Thy objectives fcr the arts commission for 198b-87 are as follows:~
1. To maintain h~,gh visibility through liaisons with city/county governmentss the
California Arts Councils and other local partnersf and utilization of local media
focussing on programs of the commission.
2. To initiate and coardanate three new programs which are an outgrowth of the work
of the director,
3. To reorganize the structure and thus the monies of the commission for the
puraoses of stimulating countywide interest in supporting the programs employing artist;
and serving a broader population of the county with ou_T activities and programs.
~.. To fundraise both at the local level and on a broader scale, including an annual
giving .campaign.
5. To provide a monthly calendar-and a quarterly newsletter.
6. To provide a central resource locat~.on for activities and satellite offices.

Levu I funding compares approximately 1/3 of the commi.ssianrs budget. The commission ha
gained considerable momentum in 1985-8n through the work of the director to begin implemE
ing the Phase III Plari, Because the goals of the commission include eventual self-suppo~
w'nile providing numerous services to the residents and artists of the couatys the
commission must initiate programs and provide services whale maintaining a high profile.

of the State/Local Partnership Program, and
WHEREAS the awarding of contracts to cities or counties under this program is
established by regulation, and
WHEREAS the regulations specity that award recommendations will be presented to
the Council, which will make the final decision and awards at a public meeting,
IOW THEREFORE BE lT RESOLVED THAT:
The Arts Council receive the recommendations of the State/Local Panel: as amended
and make final approval to fund grants in the 1986-87 State/Local Partnership
Program.
