BOARD OF SUPERVISORS OF
WHEREAS, the California Arts Council and the California
State Legislature have established the State/Local Partnership Program
designed to encourage local cultural planning and decision making
and to reach previously underserved constituents; and
WHEREAS, an application for the Level II grant program has
been submitted by the County of Butte; and
WF{EREAS, the California Arts Council has offered the Butte
County Board of Supervisors participation in the Level II California
Arts Council Grant Program should the Soard of Supervisors approve
the standard agreement acknowledging receipt of $20,000 in grant funds
requiring a match of $10,000.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board
of Supervisors does hereby authorize the Chairman to sign the standard
agreement accepting these grant funds from the California Arts Council
on behalf of the Butte County Arts Commission.

WHEREAS the California Arts Council budget far 1986-87 calls for the continuation
of the StatefLocal Partnership Program, and
WHEREAS the awarding of contracts to cities or counties under this program is
Qstablished by regulation, and
WHEREAS the regulations specity that award recommendations will be presented to
the Council, which will make the final decision and awards at a public meeting,
NOW THEREr^OR. BE IT RESOLVED THAT:
The Arts Council receive the recommendations of the State/Local Panel-as amended
and make final approval to fund grants in the 1986-87 State/vocal Partnership
Program.

a Narrative and Budget for Level Tr~-o -~
36. Narrative: Describe the proposed use of Level Two funds (see direttions). Three primary reasons e7CiSt £o:
1)~oalp~o~ns~eb.t~u~~~ County Arts Commission Phase TTT Arts Plan states," Increase the
exposure of the youth in Butte County to the county~s cultural resources and increase
their opportunities to develop their own artistic potentials." Objective 2 under this
goal ,states, ° Develop a program of Arts-in-the-Schoo~.s. Such a progra~z wou~.d .
support a program of laca.l artists in the schools. ."
2)The schools in $utte County, at presentf have art education by the classroom teachers.
Neither itinerant teachers nor fullAtime staff exists to provide art experiences for
students, Artists in Butte County are supportive of the proposed program.
3) Because of Senate Bill 513, which gives guidelines but no solutions! the county school
administration is willing to assist in funding a program of artists-in~-schools. T have
spoken with the superintendent as well as several principals and there is a positive
atmosphere far the implementation of the proposed program.
Considering the above information,.the following roject is proposed:

PRO~T: I=D PAS--•--Institute for Development of Programming Artists in Schools
Descrin_tion: This program is projected to be a three-yesr one. ~.ght pilot schools will
be involved during the first year, with e~.ght more in the second and again in the third.
The final goals.are:~ 1) to have developed a comprehensive arts-in-educat~.on program for '
schools x.n Butte County, including traditional. arts--in~-education, integrated and interrel:
arts experiences, as wel.1 as supplemental arts experiences 2) to have a staff person
county wide hired by the district to oversee arts programming in all da.sciplines 3) to
have part-time arts teachers for the district, ~,} to provide artists with employment as w~
as to expose children to experiences unique to the classroom situation.
Structure: 1986-.87 rspeox~zc timeline xs attached}
I. Planning stage: .
A. Team selection. Goal.: To select teams from each of the eight pilot schools
which are representative of community, business, school administration, artists for the
purpose of continued support and evaluation. Teams will. consist of the following:
1) artist.,2) parent 3) business person 1~) community leader (politician) ~) school
administrator 6) teacher. Teams will be selected on their application to the commission
as well. as to the principal of the pilot school,
B. Flann.ing seminar. Goal: To have teams come together in a central location for
two days to wr~,te an arts plan for their school. Guest speakers and resource people will.
assist them ~ developing their initial, first year plan. They will include; arts sducatc
from California State IIniversity, Chico; Butte County School administrators; principal-s
from the schools; artists and representatives from art organa.zatians. Following this
seminar they must submit their plan to the commission for approval..
TT. Artist Selection Process: Goal.: to maintain quality arts experiences as a standart
in this program by screening artists and establishing an artists resource file. Artists
wi11. be reviewed by a panel (see below) before working in the program.
A. Panel/Screening Committee will include:
1 } Arts Educator from California State Una.versity, Chico (3'im McMannus)
2) School Administrator (Ellis Harms, Phd. in Art Education, principal at Paradise E].eme~
3) Artists from aL1 disciplines (Catherine 5u1L~.van, Chico Community Ballet; Larry

1. The Contractor agrees to indemnify, defend and save ltiarnilcss the State, its officers, agents
and employees from any and all claims and lasses accruing or resulting to any and all contractors,
subcontractors, matcrialmen, laborers and any other person, firm or corporation furnishing or
supplying ~;•orl:, services, materials or supplies in connection with the performance of this contract,
and from any and all claims :;nd losses accruing or resulting to any person, firm or corporation
~s•ho may be injured or damaged by the Contractor in the performance of this contract.
?. The Contractor, and the agents and employees of Contractor, in the performance of this
agreement, shall act in an independent capacity and not as officers or employees or agents of
State of California.
3. The State may terminate this agreement and be relieved of the payment of any consideration

in the manner herein provided, In the event of such termination #iie State may proceed with the

7. The consideration to be paid Contractor, as provided herein, shall be in compensation for
all of Contractor's rxl~ensc~s incurrrd in the performance hereof, including travel and per diem,

SCHEDULE OF AGREEMENT
State-Local Partnership Program
1986-87 Level Two
Between California Arts Council {hereinafter called CAC) and the
aforenamed Contractor (hereinafter called Contractor and/or
Grantee) £or participation in the CAC's State-Local Partnership
for Fiscal Year 1986-87.
The State-Local Partnership Program provides support to local
arts organizations throughout California for administrative
support and project support. The objectives for this program
include: 1) Providing for the growth and development o£ those
Local Partners that have been designated by local governments
to participate in the State--Local Partnership Program; Z)
Increasing private and public Funding for the arts; 3) Increasing
cultural participation among undeserved populations in the state.
1. Contractor does hereby agree to conduct and carry out in
full the activities and/or project described in the proposal
narrative, Project Budget and Project Summary attached
hereto and incorporated herein as part of this contract.
Contractor may request to amend the project in writing to
the CAC Program Manager but shall not implement any such
changes until receipt of written approval from CAC. .
2, In consideration For the satisfactory performance of the
services specified above, CAC hereby agrees to pay
Contractor a sum not to exceed the total amount encumbered
as shown on the Standard Agreement, for items as listed on
the Project Budget, attached hereto and incorporated herein
as part o£ this agreement. Contractor shall match in cash a
a dollar amount for funding as stipulated in the state Local
Partnership Program Guidelines.
a, For Level Two funds shall be paid in arrears for
services rendered and/or goods, or services
purchased, upon receipt of an invoice submitted to
the CAC-not more often than monthly to which is
' attached documentary evidence of grant and match
expenditures' upon which the claim of payment is
based.

b. Level Two funds must be matched dollar for dollar
unless Contractor indicates on the specified farm
that new local government funds are used as match.
When such funds are used, the CAC shall, on
documentation of expenditures, reimburse Contractor
two dollars for every dollar submitted as match.
c. Budget changes shall be allowed w ithin the salary
division but may not increase or decrease a
specified line item by more than 25$. Within the
operational division the same shall apply, The
Contractor must request in writing to: z) increase
any item more than 25 0; 2) move dollars between
Salary and Operational divisions; or 3} create new
line item. Contractor shall not implement any
such requested change until receipt of written
permission from the CAC.
The CAC shall. disallow payment of any claim which
would result in payment by CAC of a sum in excess
of the total obligation of the CAC as specified on
the contract.
d. Contractor hereby agrees to report to CAC,
regarding operating and/or financial information
upon such forms. as CAC may require. Failure of
Contractor to fully, accurately and timely comply

A Summary of Receipts Form (Form A2} and List of
Receipts Form (Form B} on which each grant and
matching expenditure is entered and an invoice
sheet must accompany each invoice. The Final
Financial Statement (Form C2} must be submitted
with the last invoice in addition to the Form A2
and B.

included as part of this contract.

3. Partners shall serve as the liaison between the local arts
community and the CAC. This includes arranging
consultations consultations for CAC program staff and
prospective applicants when scheduled in the Partner's
county/city. Consultation arrangements include:
. identification and outreach to sign up prospective
applicants for appointments, telephone contact and
confirmation of appointments, facility arrangements,
publicity, and/or other requests made by CAC staff.
4. ~If travel expenses are included in the 'approved budget, the
State rules governing such expenses shall apply to the
Contractor. All travel must be within the State of
California to be reimbursable.
5. The Non-Discrimination Clause, General California Arts
Council Requirements are attached hereto and are hereby made
a part o£ this contract. The Contractor is responsible for
knowing and adhering to the requirements of these
attachments and the Program Access regulations (Section 504
of the Rehabilitation Act of 1973 and the State of
California Government Code 11135-11139.5).
6. Mention of the California Arts Council, State-Local
Partnership Program should be made in any printed, visual or
recorded matter, or in ''any exhibition, display or
performance, which describes or is prepared in connection
with, or results in whole or in part from the CAC grants.
Copies of printed matter containing such mention should be
sent to the CAC. Any documents containing such mention
shall specify that any findings, opinion, or conclusions
contained therein are not necessarily those of the CAC.
7. This grant award becomes null and void if signed contracts
are not returned within sixty (60) days of receipt from CAc
for signature.
8. This grant shall not be deemed accepted, valid or binding on
the part of the State unless approved by the Departments of
Finance and/or Genera. Serv~.ces of the State of California,
where their approval is required.

NONDISCRIMINATION CLAUSE
(MCP - ].)
1.. During the performance of this contract, contractor and 'its
subcontractors shall not unlawfully discriminate against any
employee or applicant for employment because of race,
religion, color, national origin, ancestry, physical
handicap, medical condition, marital status, age (over 40)
or sex. Contractors and subcontractors shall insure that the
evaluation and treatment of their emplayees._and appl~.cants
for employment are free of such discrim inatian. Contractors
and subcontractors shall comply with the provisions of the
Fair Employment and Housing Act (Government Code, Section
12900 et seg.) and the applicable regulations promulgated
thereunder (California Administrative Cade, Title 2, Section
7285.0 et seg.). The applicable regulations of the Fair
Employment and Housing Commission implementing Government
Code, Section 12990, set forth in Chapter 5 of Division 4 of
Title 2 of the California Administrative Code are
incorporated into this contract by reference and made a part
hereof as if set forth in full. Contractor and its
subcontractors shall give written notice of thea.r
obligations under this clause to Labor organizations with
which they have a collective bargaining or other agreement.
2. This contractor shall include the nondiscrimination and
compliance provisions of this clause ,in all subcontracts to
perform work under the contract.
