That said County approve Program Supplement No. 44 to Master Agreement No. 03-5912 for Federal-Aid Projects in Butte County and the Chairman of the Board be authorized to execute said supplement on behalf of said County. Supplement No. 44 covers emergency relief funds due to flood damage to various FAS Routes in Butte County. 2. That Clerk of this Board be authorized to attach certified copy of this resolution to Program Supplement No. 44. This Program Supplement is adopted in accordance with Paragraph 2 qt Article II of the aforementioned Heeler Agreement under authority of Resolution No. 8G-~~g ,approved by the LOCAL AGENCY on ~-~h`$6 (See copy attached?. In executing this Program Supplemental Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal--Aid Programs. 2. The Local. Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 3. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2), or its modification {PR-2A), and accepts any increases in Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Assistance. 4. The effective date of this agreement is 2-12-5& 5. Federal funds may be adjusted due to proration for entire program.
