COUNTY OF-BUTTE, STATE OF CALIFORNIA Resolution No. 86-128 RESOLUTION APPROVING AND EXECUTING THE AGREEMENT BETWEEN THE PARADTSE IRRIGATION DISTRICT AND THE COUNTY REGARDING THE EXCHANGE OF PROPERTY TAX REVENUES RELATED TO THE PARADISE IRRIGATION DTSTRICT - WILLIAMS MORRISON McCOMB5 ANNEXATION WHEREAS, the provisions of the Revenue and Taxation Code require an agreement between the County of Butte and special districts considering annexations. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that the Agreement attached hereto as Exhibit "A" is incorporated herein as if set forth in full and is hereby approved and executed by Butte County. This Agreement is made and entered into this 8th day of August 1g 86, by and between the County of .Butte, a political subdivision of the State of California, and the Paradise Irrigation District, an independent special district authorized by the Water Code of the State of California. WHEREAS, Part 0.5, of Division 1, Section gg, Subdivision B, paragraph 5 of the Revenue and Taxation Code provides as follows: "In the event that * * " a jurisdictional change would affect the service area or, service responsibility of one or more special districts, the board of supervisors of the county or counties in which * * * the districts are located shall, on behalf of the district or districts, negotiate any exchange of property tax revenues." WHEREAS, said section of the Revenue and Taxation Code further provides in Section gg.1, Subsection (a), paragraph~3: "Notwithstanding the provisions of paragraph (5) of subdivision (b) of Section 99, any special district affected by the jurisdictional change may negotiate on its own -behalf, if it so chooses." WHEREAS, Section g9 further provides in Subsection B, paragraph 8, subpart (d): "With respect to adjustments in the allocation of property taxes pursuant to this section, a county and any local agency or agencies within the county may develop and adopt a master .:.property tax transfer agreement.
