RESOLUTION APPROVING AND EXECUTING THE AGREEMENT BETWEEN THE
PARADTSE IRRIGATION DISTRICT AND THE COUNTY REGARDING THE
EXCHANGE OF PROPERTY TAX REVENUES RELATED TO THE PARADISE
IRRIGATION DTSTRICT - WILLIAMS MORRISON McCOMB5 ANNEXATION
WHEREAS, the provisions of the Revenue and Taxation Code require
an agreement between the County of Butte and special districts considering
annexations.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that
the Agreement attached hereto as Exhibit "A" is incorporated herein as if
set forth in full and is hereby approved and executed by Butte County.
PASSED AND ADOPTED by the Butte County Board of Supervisors on
this 7th day of Qctober 1986, by the following vote:
AYES: Supervisors Dolan, Fulton, McInturf, Wheeler and Chairman McLaughlin
NOES: None
ABSENT: None
NOT VOTING: None

This Agreement is made and entered into this 8th day of August
1g 86, by and between the County of .Butte, a political subdivision of the State
of California, and the Paradise Irrigation District,
an independent special district authorized by the Water Code of the State of
California.
WHEREAS, Part 0.5, of Division 1, Section gg, Subdivision B, paragraph
5 of the Revenue and Taxation Code provides as follows:
"In the event that * * " a jurisdictional change would
affect the service area or, service responsibility of one
or more special districts, the board of supervisors of the
county or counties in which * * * the districts are located
shall, on behalf of the district or districts, negotiate any
exchange of property tax revenues."
WHEREAS, said section of the Revenue and Taxation Code further
provides in Section gg.1, Subsection (a), paragraph~3:
"Notwithstanding the provisions of paragraph (5) of
subdivision (b) of Section 99, any special district affected
by the jurisdictional change may negotiate on its own
-behalf, if it so chooses."
WHEREAS, Section g9 further provides in Subsection B, paragraph 8,
subpart (d):
"With respect to adjustments in the allocation of property
taxes pursuant to this section, a county and any local agency
or agencies within the county may develop and adopt a master
.:.property tax transfer agreement. Such agreement may be revised
from time to time by the parties subject to such agreement."

NOW, TI-IEEREFORE, in consideration of the premises herebefore set forty
the parties hereto agree that no property tax exchange will occur as a result c

Annexation(s) to-the Paradise Irrigation
District.
IN WITNESS WF3EREOF, the parties hereto have executed this Agreement
the date set forth below.
