STATE 4F CALIFORNIA ~~ Resolution A1o. 86-147 RESOLUTION APPROVING COOPERATIVE FIRE AGREEMENT WITH STATE DEPARTMENT OF I=ORESTRY BE IT RESOLVED BY the Board of Supervisors, County of Butte, State of California as follows: 1. The Board of Supervisors approves the Cooperative Agreement to provide fire protection service for local agencies for fiscal year 1986-87 to be effective July 1, 1986 with the State Department of Forestry. 2. The Chairman of the Butte County Board of Supervisors is authorized to sign the agreement. 3. The agreement encompasses fiscal year 1986-87. PURPOSE •. - .The purpose of this Agreement is to provide LOCAL AGENCY with fire protection services that are mutually advantageous to LOCAL AGENCY and STATE by providing unified`, cooperative, integrated, and effective fire protection services to meet the responsibilities of STATE to protect natural resources and LOCAL AGENCX to ' protect lives and property, from forest fires, fires, and other emergencies. II. LOCAL AGENCY FIRE PROTECTION APPROPRIATIONS ' _ LOCAL AGENCY will pay to STATE for the furnishing of fire protection se prices pursuant to this agreement for the period July 1,.39 86, through 3une 30, 1987., within the area of responsibility of LOCAL AGENCY, a sum not to exceed ~ .. in total and not to exceed the amount set forth in each Schedule A, incorporated herein as to the services to be rendered pursuant to~each - such schedule. - All payments to be made to STATE by LOCAL AGENCY for services provided by STATE during the period indicated above pursuant to any provision of this agreement are included within the respective Schedules A incorporated herein. Any other funds designated. by LOCAL AGENCY to be expended under the supervision of, ar for the use•of, a State Forest Officer far fire protection services during the term of this agreement shall be set out in Schedule C attached hereto and incorporated herein. ADMINISTRATION -- ' Under the requiremeats~af California Public Resources Code Section 4114 and ~~- other provisions of-law,°STATE maintains, fire 'prevention and firefighting services including the necessary personnel, apparatus, structures, aad communications as outlined in Schedule •B, attached hereto and made a part hereof: ` .. ~ ~. _.. A. AIRECTOR will select and employ a•State Forest Officer who snail, under - - _• -• - - -~ the supervision and -direction of DIRECTp$ or a 'lawful representative, have charge of Che organization described in Schedules A, S, and C. $. LOCAL AGENCY-may appoint the State Forest Officer as the County Fire ` Warden or Chief Fire Protection Officer pursuant to Goverrm~ent Code Section 24008, Public Contracts Cade 5ettion 20811, ar other applicable appointing authority. ~ , C. The State Forest Officer ,nay dispatch personnel and equipment listed in Schedule{s) A-4I42 from the assigned statiaa or location from time to -. - -time under guidelines established by LOCAL AGENCY and approved by STATE. Personnel and equipment listed in Schedule B, except Chase specifically assigned to fire protection services during the period designated "N" {Nonfire Season) on Schedule A, rosy be dispatched at the sole discretion of STATE. • The State Forest Officer shall exercise his best professional judgment in authorizing or making any assignments to emergencies and other responses, including assignments made in response to requests for mutual aid. D. Except as specifically pravid~d herein or by separate agreement, STATE shall assume no responsibility within the area of jurisdiction of the T3nited States government, ar lands within the corporate limits of aal- city. - E. The performance of or prevision far any service not specified herein by either STATE or LOCAL AGENCY-.shall be in pursuit of the ,separate mission of the party performing or making provision far such service sad shah not be at the expense of the other party, F. STATE shall not~incur any obligation on the part of LOGAL AGENCY to pay far any lobar, materials, supplies or services beyond the total set forth in the respective Schedules A as to the services to be rendered pursuant to each such Schedule. •G. Nothing herein shall alter ar amend ar be construed to alter or amen say Collective Bargaining Agreement or Memorandum of IInderstanding between the State of California and its employees under the State Fatployer- Employee Relations Act. - IV. V. CHANGES IN LEVEL of SEgVICE QR LDCAL AGENCY' APPRQPRIATION A-41 A. If L{3CAL AGENCY requests a reduction in the number of personnel, by Civil Service Classification, assigned to the organization provided for in Schedule{s} A, excluding Schedule A-4144, LOCAL AGENCY shall be responsible far any rElacatian casts of State employees involved except: 1. A reduction is personnel requested ar implemented due solely to an increase in the cost of salaries or expenses of STATE, or 2. Requests which will result in the redaction of personnel during the contract period identified in Section II, above, as°_faliaws: • a. The first employee in any Civil Service Classification, and b. Additional employees in the same Civil Service Classification-up to a total, including the one employee in {a}, above, representing I(lx (rounded to the nearest whole number) ar less of aII employees in such classification. c. Seductions in personnel which occur at or after the end of the contract period following the giving by LOCAL AGENCY of ninety (9D) days advance notice of such reduction. B. STATE'S concurrence shall not be unreasonably withheld. An amendment to this Agreement shall be promptly processed to reflect such change(s). VI. PAYMENT FOR SESVICES ' A.. STATE sisall snake claim for the cost of fire protection services on a _ quarterly basis as follows: - 1'. Far the estimated cast of services during the •period April 1 through June 30, by a claim filed is advance with LOCAL AGENCY an or after March 1; and • 5. Eacept when otherwise specifically agreed to in writing by the STATE and the LOCAL AGENCY, services provided and abligatians incurred during the period of "holding-aver" provided far in a previous agreement, ar ather- wise prior to the eaecutioa of this agreement, but after the beginning of the fiscal year to which this agreement applies, are accepted as services and obligations under the terms of this agreement. E. IIpan reasonable antics from LOCAL AGENCY, records and books of STATE relating to this agreement shall be made available for-audit by LOCAL AGENCY at the office of the DIRECTOB. -` R. All claims frsr payment to STATE from LOCAL. AGENCY funds shall be filed with 1ACAL AGENCY in the manner prescribed ~by LOCAL AGENCY. YII. HOLDING-flVE~ It is hereby uaderstaad and agreed that unless STATE, before the expiration of this agreement, receives a written notice from LOCAL AGENCY giving STATE at Ieast ninety (90) days notice of LOCAL AGENCY's decision to terminate or not renew this agree eat, then this agreement shall be automatically extended at the same level of service, at the level of expense applicable during the "hold-over" period, sad otherwise on the same terms and conditions herein specified, so far as applicable, until the date on which a renewal agreement is fully executed, or the effective date of termination of this "hold-aver" agreement fallowing STATE'S receipt of ninety (90) days prior written terjninatian notice, whichever is saaner. The cost of services provided by STATE during any "bald-over" period in the fallowing fiscal year shall be at the level of expense applicable during the "hold-over" period and be paid by LOCAL AGENCY from funds other than those included is the attached Schedule(s) A, A-41 -5- fOb0585) VIII. INDEMNIFICATION - G A-41 LOCAL AGENCY, to the extent permitted by law, agrees to indemnify, defend, and hold-harmless STAT£, its officers, agents and employees from ,and against 'any and alI claims and losses whatsoever accruing or resulting to any aad all persons, firms, ar corporations furnishing or supplying work, services, materials, or supplies in 'connection with • activities pursuant to any provision of Schedules A and C attached hereto. 'Said certificate must be executed by a duly authorized officer of LOCAL AGENCY, and a true copy attached hereto as a part of this agreement. If comercially insured, a certificate of such coverage, executed by the insurer (or authorized. representative), will be provided and attached hereto. If LOCAL AGENCY is self-insured, evidence of Workers' Compensation coverage will be provided is the same manner as required in Section VIII, Paragraph E. SITPPR£SSIUN COST RECOVERY As provided in Health and Safety Code fH&SC) Section 13009, STATE may bring an action for collection of suppression costs of any fire occurring on forest, range ar nonresidential grasslands during the term of this agreement. When using LOCAL AGENCY equipment and personnel under the terms of this agreement, STATE may, an request of LOGAL AGENCY, bring such an action for collection of costs incurred by LOCAL AGENCY in rxhich case LDCAL AGENCY appoints and designates STATE as its agent_in said callectioa proceedings. In~the event of recovery, STATE will apportion to LOCAL AGENCY its pro-rata proportion of recovery, less the reasonable pro-rated costs, incluaing legal fees.. In all such instances, STATE shall give timely notice to the officer designated by LOCAL AGENCY, of the passible application of S&SC Section 13009. %I. TOITUAL AID When rendering sautual aid.,or assistance as authorized in H~SC Section 13050 and 13054, STATE may, on request•of LOCAL AGENCY, demand payment of charges and seek reimbursement of LDCAL AG'ENCY~casts for personnel as funded herein, under authority given by H~SC Section 13051 and 13054. STATE, in seeking said reim- bursement pursuant to such request of LOCAL AGENCY, will represent LOCAL AGENCY in following the procedures set forth in H~SC Section 13052. Any recovery of LOCAL AGENCY costs, less expenses, will be paid or credited Lo LDCAL AGENCY, as elected by LOCAL AGENCY. C. In the case of LOCAL AGENCY-acrned vehicles provided by LOCAL AGENCY, for. - performance as contemplated hereunder, but net included in Schedule A: - 1. STATE shall confor=m to galicies of LOCAL-AGENCY in operation, use, • care and maintenance of said vehicles. ~ ' 2. LOCAL AGENCY shall assume full responsibility for all casts associated with the acquisition, operation, use, care, maintenance and replacement of said vehicles. D. Except where LOCAL AGENCY would have no duty to indemnify 5TATE under Section VILI hereof,.for all LOCAL AGENCYrowned vehicles operated ar used by employees of STATE;.;under the terms of this agreement, LOCAL AGENCY . assumes full responsibility far all liabilities associated therewith in accordance with California Vehicle Code Sections 17000, 17001 et seg. Such STATE employees operating LOCAL AGENCY-roWned vehicles will be deemed • employees of LOCAL AGENCY as defined in Vehicle Code Section I7000. Except where STATE would have no duty to indemnify LOCAL AGENCY under . Such notice shall specify a termination date which shall be no sooner than twelve (12} months and no Inter than twenty-four {24) months fallowing giving of notice. This date may be ~nadified by mutual written consent of STATE and LOCAL AGENCY. The only exception to this notice reouirement shall be far violation of Sectiaa VI.A.6. requiring LOCAL AGENCY payment for services *aithia a specified period.
