RESOLUTION SETTING FEE SCHIDULE ',
FOR AGRICULTURAL SERVICES ',
WHEREAS, Food and Agricultural Code Section 11734
permits the Board of Supervisors to establish fees for issuing
Pest Control Operators Registrations; and
WHEREAS, Food and Agricultural Code Section 12034
authorizes the Board of Supervisors to establish fees for the
registration of Pest Control Advisors; and
WHEREAS, Food and Agricultural Code Section 11923
authorizes the Board of Supervisors to establish fees for the
registration of Fest Control Aircraft Pilots; and
WHEREAS, Food and Agricultural Code Section 15204
authorizes the Board of Supervisors to establish fees for the ',
notification of Structural Pest Control Operators; and
WHEREAS, Food and Agricultural Code Sections 29112 and
29276 permits the Board of Supervisors to establish a fee
schedule for Apiary Inspection Services; and
WHEREAS, Food and Agricultural Code Section 5202
permits the Board of Supervisors to establish fees for the
certification of Plant Shipments; and
WHEREAS, Food and Agricultural Code Section 42793 ',
permits the Board of Supervisors to establish fees for the
certification, inspection or certificates for fruits, nuts and ',
vegetables; and
WHEREAS, California Administrative Code Section 1392.6
permits the Board of Supervisors to establish fees for issuing,'
monitoring, or renewing Direct Marketing Certificates for either
Certified Producers or Certified Farmers Markets; and ',
WHEREAS, Butte County Code Chapter 37, Ordinance No.
2562 permits the Butte County Board of Supervisors, by resolution
to set fees for any inspection and destruction of honeybees
required pursuant to the ordinance;
NOW, THEREFORE BE IT RESOLVED that Resolutions 66-87, ',
72--17, and 80-34 be hereby amended and incorporated into this
resolution.
BE IT FURTHER RESOLVED that the Board of Supervisors
adopts the following fee schedules for the above referenced
services.
SCHEDULE OF FEES
A. QUARANTINE CERTIFICATION INSPECTIONS
1. Inspection Authorized Butte County Ordinance Chapter
37. Butte County Acarine Mite Quarantine. Fees, see
part J.
B. AGRICULTURAL PEST CONTROL OPERATOR REGISTRATION
1. Twenty five dollars {$25.00) per year for Agricultural,
Pest Control Operators and Maintenance Gardeners.
2. There shall be no fee charged for registration of fee ',
exempt Agricultural Pest Control Operators.
C. AGRICULTURAL PEST CONTROL ADVISOR'S REGISTRATION
Ten dollars ($10.00) per year for Pest Control Advisors who'
register in person in the county and who have listed on
their license and addres in the county or who choose this as
the county of occupational choice, as the case may be, and
five dollars ($5.00) per year for an advisor who is now
registering in an additional county.
D. AGRICULTURAL PEST CONTROL AIRCRAFT PILOTS REGISTRATION
'Ten dollars ($10.00) per year for Aircraft Pilots who
register in person in this county and five ($5.00) per year',
for Pest Control Aircraft Pilots already registered in ',
another county who is now registering in an additional
county (as evidenced by possession of a Pest Control
Aircraft Pilot County Registration Application imprinted by',
another county).
E. STRUCTURAL PEST CONTROL OPERATOR NOTIFICATION
Ten dollars ($10.00) per year for structural pest control
operator notifying the agricultural commissioner that they
intend to work in this county.
F. APIARY INSPECTION SERVICES

1. Inspection Authorized. Interstate movement. Upon ',
request of the owner or shipper of an apiary or apiary
appliance who requires a Certificate of Apiary ',
Inspection in order to move such apiary to another
state, the County Agricultural Commissioner shall make..
such inspections as may be necessary to determine the
facts required by the state of destination of such
apiary or apiary appliance. Fees, see Part J.
2. Inspection Authorized. Cerification of Colony
Strength. Upon request of the beekeeper or
agricultural producer involved who requires a
certificate of colony strength for bees used in
pollination of agricultural crops, the commissioner may
make such inspections as are necessary to determine the
facts required. Fees, see part J.
3. Issuance of Certificate. After making the inspection
provided for in paragraph 1 or 2 and upon receipt of
the required fee, the Commissioner shall issue a
Certificate of Apiary Inspection stating the facts
determined.
G. PLANT SHIPMENT INSPECTION FOR CERTIFICATION
Federal and state Phytosanitary Certificates shall be
charged at the following rate:
1. Field inspection required by the receiving country,
state or county shall be charged as stated in part J.
2. Fee exemptions.
a. No fee shall be charged for certification required
by any law, regulation or requirement of the
United States or of this state or by any
ordinance, regulation, or requirement of any
county of this state.
b. No fee shall be charged for one package only, when
the package is brought to the Agricultural
Commissioner's Office for inspection.

Definition of a package: any box, bundle, sack, flat,'
crate or carton containing certifiable material or one
hundred pounds in bulk.
H. FRUIT, NUT AND VEGETABLE CERTIFICATION INSPECTION
Inspection and Certification Authorized. Upon request by ',
owners, shippers, or other interested parties the county
agricultural commissioner may make such inspections as may
be necessary to issue such certificates. Fees, see part J.',
I. CERTIFICATION OF FARMERS MARKETS AND CERTIFIED PRODUCERS
1. Five dollars ($5.00) for each Certified Producer's
Direct Marketing Certificate.
2. Fifteen dollars ($15.00) for each Certified Farmers
Market Direct Marketing Certificate.
J. For all inspection indicated in this resolution for which ',
there is not otherwise established a specific fee schedule
the fee charged shall be based on the actual cost of ',
inspection. The cost of inspection shall be the actual cost
of inspection, and said cost of inspection shall be
determined as the actual hourly labor cost of the
Agricultural Commissioner or Deputy Agricultural
Commissioner far the actual time required to conduct such ',
inspection and/or certification, together with prevailing
employee benefits and administrative overhead costs based
upon the total charges, and charges for mileage based on the
recommendation of the Butte County Auditor's assessment for'
the type of vehicle used.
In addition to the above if an inspection and/or
certification is requested at times other than the normal
working hours of the department which are Monday through
Friday, 8:00 a.m. to 5:00 p.m., and personnel are available'
to conduct such inspection, the inspection cost shall
reflect any overtime salary expense as required.
BE TT FURTHER RESOLVED that these fees become effective
December 17, 1986 and that the agricultural commissioner be and
is hereby authorized to collect such fees.
