HomeMy WebLinkAbout863i ORDINANCE NO.~~ 1 `2 3! 4 5 6 7 8 9 IO 11 12 13 14 15 16 17 '18 19 '20 21 22 23 24 '25 26 27 '28 29 30 31 32 AN ORDINANCE ESTABLISHING SPEED LIMIT ON CERTAIN ROAD WITHIN THE COUNTY OF BUTTE, STATE OF CALIF- ORNIA CVehicle Code Section 22358) The Board of Supervisors of the County of Butte, State of California, do ordain as follows: SECTION 1_ Said Board finds and determines that upon the basis of an engineering and traffic survey, the County highway hereinafter described comes within the provisions of Section 2235 of the Vehicle Code of the State of California, in that a maximum speed limit of sixty-five (65) miles per hour is more than is reasonable and safe on said highway, and determines and declares a prima facie speed limit on such County highway as follows: SECTION 2: That a prima facie speed limit of twenty-five C25) miles per hour is hereby determined, declared and establi upon the hereinafter described County highway, to wit: On TRES VIAS ROAD, from 20th Street to Larkin Road SECTION 3: That SPEED LIMIT 25 MILES signs be placed at appropriate locations on the road described in 'Section 2. SECTION 4: All ordinances or parts of ordinances in con- flict herewith are hereby repealed. SECTION 5: The several features, parts, provisions, sect-. ions and terms of this ordinance are hereby declared independent and severable, and the invalidity, if any, of any feature, part, provisions, section or term thereof shall not affect the re- mainder of this ordinance nor render the same inoperative or invalid. SECTION 6: The Department of Public Works of the County of Butte is hereby directed to erect appropriate signs giving notice of the prima facie speed limits established herein immediately. It is further ordained by the Board of Supervisors of the County of Butte, State of California, that this ordinance shall g'G 3 l 2 3 ,~ '5 Ie '7 81 9 to 11 12 13 ,1~4 15 `16 i17 !18 19 '20 2X 22 i23 2~4 25 26 27 28 29 30 31 32 be, and it is hereby declared to be, in full force and effect from and after this time of its passage, pursuant to the urgency herein aftex found and declared. That this ordinance is for the immediate preservation of the health and safety of the xesidents and inhabitants of Butte County. That the facts constituting the urgency are as follows: That without this legislation, it is deemed that the dust condition which would be created without this speed limit being enforced is an extreme hazard to the health and welfare of the citizens of the area. The Clerk of the Board of Supervisors is hereby authorized and directed to cause this ordinance to be published with the names of the members voting for and against the same, at least once in a 1oca1 newspaper published in the County of Butte, State of California.
