STATE OF CALIFORNIA IZesolufion N o. 87-13 RESOLUTION ADOPTING DEPARTMENTAL POLICY STATEMENT PURSUANT TO GOVERNMENT CObE §1X26(B) WHEREAS, this Board has received a joint request from the Butte County Assessor and the Butte County Treasurer-Tax Collector seeking approval and adoption of the attached policy statement for their respective departments; and, WHEREAS, pursuant to Government Code §1126(b), this Board may take such action; and WHEREAS, this Board believes it would be a conflict of interest and bring discredit to the County for any member of the Assessor's or Treasurer-Tax Collector's Department or staff to bid or purchase, or assist another to bid or purchase at a County sale of, property for defaulted taxes, NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors: 1. The attached policy statement by the Butte County Assessor and the Butte County Treasurer-Tax Collector is .hereby approved and adopted. 2. Said policy is effective immediately and shall remain in effect until jointly rescinded by the Board of Supervisors and the Assessor and Tax Collector then in office. PASSED AND ADOPTED by the Butte County Board of Supervisors this 3rd day of February 1987, by the following vote: AYES: Supervisors Fulton, McTnturf, McLaughlin, Vercruse and Chair Dolan NOES: None ABSENT : None NOT VOTING: None ATTEST; MARTIN J. NICHOLS, Chief Administrative Officer and Clerk of the Board County Board of Supervisors By r`~1.~-~t~_f 7~g - Tn accordance with Government Code §1Y26(b), county department heads may determine, subject to Board of Supervisors' approval, those outside activities which, for employees under ~~•- its jurisdiction, are inconsistent with, incompatible to, or in :- conflict with their duties as local agency officers or employees. The Assessor and the Treasurer--Tax Collector have ' determined that it would be a conflict of interest and bring .• ~ discredit to the County for any member of their departments •~. or staff to bid on or purchase property at a County sale of property for defaulted taxes. Therefore, no member of the Assessor's or Treasurer-Tax . Collector's Department or staff shall be a bidder or purchaser - ~ (or assist anyone else in bidding or purchasing) at a County sale of property for defaulted taxes, whether as an individual, through a spouse or any legal entity in which he or she has any • ~ ..financial interest whatsoever, :. Bidding or purchasing, or assisting another in bidding on or purchasing, property at a tax default sale in violation of '. this rule shall be grounds for disciplinary action as set forth in the Butte County Merit System and Personnel Rules. This policy is effective on the date it is approved • by the Butte County Board of Supervisors. Upon adoption of this policy by the Board of Super-- visors, the Assessor and Treasurer-Tax Collector shall provide each current employee with a copy of this policy. Every new employee of said departments sha11 be provided with a copy of this policy to be signed and dated and returned to the depart- ment to be included in the employee's personnel file.
