HomeMy WebLinkAbout87-026d~ f i 4 ~eso~ution No.87-26 RESOLUTION AMENDING SECTION 9.1 TO THE BUTTE COUNTY PERSONNEL RULE'S WHEREAS, the Board of Supervisors of the County of Butte has established the composition of the Appeals Commission to consist of five members and three alternates and WHEREAS, the Board of Supervisors has been informed by the Appeals Commission that they desire an additional number of alternates; NOW, THEREFORE, BE iT RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 9.1 of the Butte County Resolution 76-136A to read as follows: 9.1 Composition of Appeals Commission a. The Butte County Personnel Appeals Commission shall have the power and authority to decide matters regarding appeals involving disciplinary actions, grievances, acts of discrimination and selection appeals. b. The Commission shall be appointed by the Board and shall consist of {5) five members and (5) five alternates. Nominations to the Board for Commission appointments shall be made in the following manner: {2) two members and (2) two alternates nominated by the management council: (2) two members and (2) two alternates nominated by mutual agreeement of the recognized employee organizations in the county. Each alternate will be assigned as the alternate for a specific commissioner, but may serve as the second alternate to the other commissioner nominated by the same body. It shall be the responsibility of the employee organizations to establish their own procedures to resolve the nomination issue when mutual agreement cannot be reached. The (4) four member nominees shall nominate a fifth member and (1) one alternate by mutual consent. If agreement cannot be reached on the member or the alternate, each nominee shall submit a name to the Clerk of the Commission and the nomination shall be made through the efforts of the State Conciliation Service. Any costs incurred shall be divided one-half to the County and one-half to the recognized employee organizations involved. c. The first commission shall classify its members by lot, such that {2) two shall serve for a term not to exceed (2) two years; (2) two shall serve fora term not to exceed (3) three years; and {1) one shall serve for a term not to exceed (4) four years. At the expiration of each term, as so provided, a successor sha1T be nominated by the authority which nominated the member whose position has become vacant, whether by expiration of term or otherwise. Appointees appointed to complete a term shall serve the time remaining on that term. A11 appointees appointed to serve a new term shall serve for {4) four years. Rlternate members shall be appointed to a {2) two year term. A71 terms expire on December 31 of the expiration year. The Commission shall, at its first meeting, and annually thereafter, on or before January 30th, select {1) one of its regular members to act as Chair and another to act as Vice-Chair.
