RESOLUTION SUSPENDING IMPOSITION OF SCHOOL FEES
IN THE CHICO UNIFIED SCHOOL DISTRICT; E%CEPTIONS
WHEREAS, the Board of Supervisors of the County of
Butte previously enacted Ordinance 24-63 and by resolution
pursuant thereto adopted a schedule of fees applicable to
residential developments within the Chico Unified School
District; and
WHEREAS, said school fees were increased effective
December 3, 1986, to continue in effect until .such time as the
Board of Education of the Chico, Unified School District took
independent action pursuant to the authority granted it by
Assembly Bi11 2926 and Senate Bill 2068, chaptered as Chapters
887 and 888, respectively, of the Statutes of 1986; and
WHEREAS, on January 7, 1987 the Board of Education did
take independent action pursuant to said authority by adopting
Resolution 340-87 imposing school fees on development projects
within the boundaries of the Chico Unified School District,
effective March 9, 1987, but said resolution may not be
applicable to all such residential developments approved on or
after March 9, 1987; and
WHEREAS, it would be inequitable for some of said
residential developments to be required to pay school fees
pursuant. to Board of Education Resolution 340-87 but for other
residential developments not to be required to pay any school
fees at all.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors:
1. Imposition of Fees Suspended. Except as otherwise
provided herein, no school fees shall be imposed pursuant to
Ordinance 24-63, or any resolution thereunder adopting a schedule
of fees, as to any residential development approved on or after
March 9, 1987, within the Chico Unified School District.
2. Exceptions. If Resolution 340-87 of the Board of
Education of the Chico Unified School District does not apply, or
if fees cannot be imposed pursuant thereto, as to any residential
development approved on or after March 9, 1.987, within the Chico
Unified School District, then Ordinance 2463 and any resolution
thereunder adopting a schedule of fees shall be applicable
thereto.
PASSED AND ADOPTED by the Butte County Board of
Supervisoxs this 17th day of March 1987, by the
following vote:
AYES: Supervisors Fulton, McLaughlin and Chair Dolan
NOES: Supervisors McInturf and Vercruse
ABSENT: None
NOT VOTING: None
