RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS REGARDING MEASURE E
WHEREAS, the voters of Butte County in the November 1986 general election
adapted a charter amendment restricting payments for welfare costs to the level
of 1978-79; and
WHEREAS, this action by the voters is a result of the financial crisis
facing counties due to the increasing cost of state mandated programs; and
WHEREAS, the Superior Court for the County of Butte has issued an
Announcement of Tentative Decision in the McMahon v. Dolan action (Measure E
Lawsuit); and
WHEREAS, the court finds that counties as political subdivisions of
this state are entitled to due process of law; and
WHEREAS, the court finds that the California Constitution, Article 16,
Section 11, requires the State of California to pay for state mandated welfare
costs; and
WHEREAS, Measure E will significantly impact alT California counties.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors
requests that the County Supervisors Association of California actively participate
in the appellate process; and that CSAC assist in the coordination of all Chief
Administrative Officers and County Counsels to provide statewide representation
in the appeal.

AYES: Supervisors Fulton, hlcInturf, McLaughlin, Vercruse and Chair Dolan
