Resolution No. 87-86
RESOLUTION APPROVING THE APPLICATION FOR GRANT FUNDS
UNDER THE COMMUNITY PARKLANBS ACT OF 1986
WHEREAS, applications for grant funds under the Community Parklands
Act of 1986 have been received for the following projects:
City of Oroville - Hewitt Park S 20,000
Paradise Recreation and Park District - Bille Park 24,963
City of Biggs - Biggs City Park 20,000
Town of Paradise - Paradise Memorial Trailway 20,000
Chico Area Recreation and Park District - Community Park 61,209
WHEREAS, the people of the State of California have enacted the
Community Parklands Act of ].986, which provides funds to the State of
California and its political subdivisions for acquiring and developing
facilities for public recreational and historical purposes; and
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of the program within the
state, setting up necessary procedures governing application by local agencies
under the program; and
WHEREAS, said procedures established by the State Department of
Parks and Recreation require the applicant to certify by resolution the
approval of applications before submission of said applications to the state;
and
WHEREAS, said applications contain assurances that the applicants
must comply with; and
WHEREAS, the applicant agencies will enter into an agreement with
the State of California for acquisition, development, rehahilitation or
restoration of the projects.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of
Supervisors hereby:
1. Approves the filing of applications for Community Parklands Act
of 1986 state grant assistance for the above projects; and
2. Certifies that said agency understands the assurances and
certification in the application form; and
3. Certifies that said agency has or will have sufficient funds to
operate and maintain the projects; and

4. Certifies that said agency will complete the projects within
three years from date of approval by the state; and
5. Appoints the following as agents of the County of Butte to
conduct all negotiations, execute and submit all documents
including but not limited to applications, agreements,
amendments, payment requests, and so on, which may be necessary
for the completion of the aforementioned projects:
City of Oroville - City Manager
City of Biggs - Mayor
Paradise Recreation and Park District - District Manager
.Chico Area Recreation and Park District - District Manger
Town of Paradise - Town Manager

State of California, this 2nd day of June, 1987, by the following vote:

COMMUNITY PARKLAND ACT BOND AGREEMENT
BETWEEN COUNTY OF BUTTE AND
CHIC4 AREA RECREATION AND PARR DISTRICT
THIS AGREEMENT, made in Oroville, County of Butte, State of
California, and executed in triplicate as of the 2nd day of
June 19 87, by and between the County of Butte,
hereinafter referred to as COUNTY and the Chico Area Recreation and Park
District, hereinafter referred to as RECREATION AGENCY.
W I T N E S S E T H:
WHEREAS, RECREATION AGENCY is the owner of all that certain real
property, located in the City of Chico, generally known as Community Park,
which is located at the northerly end of Whitman Avenue; and
WHEREAS, RECREATION AGENCY desires to install additional facilities
and to construct additional improvements at said Park; and
WHEREAS, COUNTY is desirous of providing its cooperation and
assistance in such efforts; and
WHEREAS, grant funds will be available to COUNTY and the' RECREATION
AGENCY from the Community Parkland Act of 1986 far park and recreation
improvements in Butte County.
NOW, THEREFORE, in consideration of the mutual covenants, promises,
terms and conditions herein contained, it is hereby agreed by and between the
parties hereto as follows:
1. APPLICATION OF GRANT FUNDS: COUNTY and RECREATION AGENCY jointly
agree to apply grant funds received by each, pursuant to the
aforementioned Act, to the improvement of Community Park as
follows:
a. COUNTY - $ 61,2D9
b. RECREATION AGENCY - $ 97,Oa0
2. DESIGNATION OF LEAD AGENCY: RECREATION AGENCY agrees to act as
lead agency in the administration of any grant funds received,
undertake such accounting procedures as may be required by State
in connection therewith, and to develop plans, specifications and.
contract documents, award a bid or bids. and supervise all
installation and construction activities, all in a timely manner.
3. COOPERATIVE CONSULTATION: During all phases of the work, COUNTY
and RECREATION AGENCY agree to cooperate and consult mutually as
may be required.
4. ACCEPTANCE: MAINTENANCE AND OPERATION: Following the completion
and acceptance of the facilities and improvements, RECREATION
AGENCY agrees to operate and maintain them, at its sole cast and
expense.
5. INDEMNIFICATION: RECREATION AGENCY shall hold harmless,
indemnify and defend COUNTY with regard to all claims arising out
of the performance of this agreement.
IN WITNESS WHEREOF, we have hereunto set out hands the day and year

between the County of Butte, hereinafter referred to as
COUNTY and the Town of Paradise, hereinafter referred to
as TOWN.

WHEREAS, TOWN is the owner of all that certain
real property, located in the Town of Paradise,
generally known as the Paradise Memorial Trailway;
WHEREAS, TOWN desires to install additional
facilities and to construct additional improvements
along said Trailway;
WHEREAS, COUNTY is desirous of providing its
cooperation and assistance in such efforts; and
WHEREAS, grant funds will be available to COUNTY
and TOWN from the Community Parklands Act of 1986 for
park and recreation improvements in Butte County.
NOW, THEREFORE, in consideration of the mutual.
covenants, promises, terms and conditions herein
contained, it is hereby agreed by and between the
parties hereto as follows:
1. APPLICATION OF GRANT FUNDS:
COUNTY and TOWN jointly agree to apply grant
funds received by each, pursuant to the aforementioned
Act, to the improvement of the Paradise Memorial
Trailway as follows:
a. COUNTY - $20,000
b. TowN ~ $24,ooa
2. DESIGNATION OF LEAD AGENCY:
TOWN agrees to act as lead agency in the
administration of any grant funds received, undertake
such accounting procedures as may be required by State
in connection therewith, and to develop plans,
specifications and contract documents, award a bid or
bids, and supervise all installation and construction
activities, all in a timely manner.
3. COOPERATIVE CONSULTATION:
During all phases of the work, COUNTY and TOWN
agree to cooperate and consult mutually as may be
required.
4. ACCEPTANCE: MP,INTENANCE AND OPERATION:
Fallowing the completion and acceptance of the
facilities and improvements, TOWN agrees to operate and
maintain them, at its sale cost and expense.
5. INDEMNIFICATION:
TOWN shall hold harmless, indemnify and defend
COUNTY with regard to all claims arising out of the
performance of this Agreement.

parties hereto as follows:

WHEREAS, grant funds will be available to COUNTY and the RECREATION
AGENCY from the Community Parkland Act of 198fi for park and recreation
improvements in Butte County.
NOW, THEREFORE, in consideration of the mutual covenants, promises,
terms and conditions herein contained, it is hereby agreed by and between the
parties hereto as follows:
1. APPLICATION OF GRANT FUNDS: COUNTY and RECREATION AGENCY jointly
agree to apply grant funds received by each, pursuant to the
aforementioned Act, to the improvement of Community Park as
follows:
a. COUNTY - $ 24,963
b. RECREATION AGENCY - $ 73,000
2. DESIGNATION OF LEAD AGENCY: RECREATION AGENCY agrees to act as
lead agency in the administration of any grant funds received,
undertake such accounting procedures as may be required by State
in connection therewith, and to develop plans, specifications and
contract documents, award a bid or bids, and supervise all
installation and construction activities, all in a timely manner.
3. COOFERATIVE CONSULTATION: Auring all phases of the work, COUNTY
and RECREATION AGENCY agree to cooperate and consult mutually as
may be required.
4. ACCEPTANCE: MAINTENANCE AND OPERATION: Following the completion
and acceptance of the facilities and improvements, RECREATION
AGENCY agrees to operate and maintain them, at its sole cost and
expense.
5. INDEMNIFICATION: RECREATION AGENCY shall hold harmless.
indemnify and defend COUNTY with regard to all claims arising out
of the performance of this agreement.

and CITY agree to cooperate and consult mutually as may be
required.
4. ACCEPTANCE; MAINTENANCE AND OPERATION: Following the completion
and acceptance of the facilities and improvements, CITY agrees to
operate and maintain them, at its sole cost and expense.
5. INDEMNIFICATION: CITY shall hold harmless, indemnify and defend
COUNTY with regard to all claims arising out of the performance
of this agreement.

A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AN AGREEMENT BETWEEN COUNTY OF BUTTE AND
CITY OF OROVILLE FOR COMMUNITY PARKLANDS BOND ACT FUND
{Agreement No. 873-87)
NOW, THEREFORE, BE IT RESOLVED by the Oroviile City
Council as follows:
The Mayor is hereby authorized and directed to execute
an agreement between County of Butte and City of Oroville for
Community Parklands Bond Act Fund.
The City Clerk shall attest to the adoption of this
Resolution.
PASSED AND ADOPTED by the Council of the City of
Oroville at Regular Meeting , on June 1, 1887,
by the following vote: '
