HomeMy WebLinkAbout87-220 1_- __ - --- _- _ ^ BOARD OF_,SUPERVISQRS i COUNTY OF BUTTE, STATE OF CAL{F0RIVIA Resolufion No. 87_220 RESOLUTION OF THE COUNTY OF BUTTE ANNEXING TERRITORY TO COUNTY SERVICE AREA N0. 23 (CERES ESTATES UNIT 2) WHEREAS, Drake Homes has petitioned the Local Agency Formation Commission for inclusion of their parcels within County Service Area No. 23; and WHEREAS, the Butte County Local Agency Formation Commission has approved this annexation and designated it: 87-7 - Annexation to CSA 1123 - Drake Homes (Ceres Estates Unit 2), the exterior boundaries of which are described in Exhibit "A" attached hereto and made a part hereof by this reference; and WHEREAS, the Butte County Local Agency Formation Commission has duly approved and authorized the Board of Supervisors to annex such territory without notice and hearing by the Board and without an election; and WHEREAS, the territory is uninhabited; and WHEREAS, the reason for this annexation is to provide storm drainage maintenance. NOW, THEREFORE, BE IT RESOLVED that said territory described in Exhibit "A" described as 87-7 - Annexation to CSA 1123 - Drake Homes (Ceres Estates Unit 2), is hereby annexed to and included within the boundaries of County Service Area No. 23. BE IT FURTHER RESOLVED that said territory shall be taxed to pay any indebtedness or liability of County Service Area No. 23 prior to or existing at the time of annexation. NICHOLS Chief Administrative Officer and Cl k of the Board By ATTACHMENT "A" ANNEXATION TO COUNTY SERVICE AREA 23 PLEASANT VALLEY DRAINAGE ASSESSMENT DISTRICT All that certain real property situate in the County of Butte, State of California, described as follows: Lot 7 and a portion of Ceres Avenue (formerly Sycamore Avenue), as shown on that certain map entitled, "Fifteenth Subdivision of the John Bidwell Rancho, near Chico, Butte County, California," recorded in the Office of the County Recorder of the County of Butte, State of California, in Book 6 of Maps at page 48, more particularly described as follows; Commencing at the centerline - centerline intersection of Lupin Avenue and Ceres Avenue as shown on said map; THENCE South 00°54'57" East, along said centerline of Ceres Avenue, a distance of 50.01 feet; THENCE leaving said centerline, South 89°03'45" West, a distance of 30.00 feet, to a point lying on the West right-of-way line of Ceres Avenue; THENCE along said right-of-way line and parallel with said centerline, South 00°54'57" East, a distance of 635.09 feet, to the True Point of Beginning; THENCE continuing along said right-of-way line and parallel with said centerline, South 00°55'35" East, a distance of 660.69 feet to a point which lies on the Westerly projection of the South line of Lot 7; THENCE North 89°05'22" East along said Westerly projection and said South line, a distance of 689.88 feet, to the Southeast corner of said Lot 7; THENCE along the East line of said Lot 7, North 00°55'41" West, a distance of 650.99 feet, to the Northeast corner of said Lot 7; THENCE along the North line of said Lot 7 and the Westerly projection thereof, South 89°03'52" West, a distance of 689.86 feet, to the True Point of Beginning; The above described parcel contains 10.47 acres, more or less. des4 ~1~~
