RESOLUTION TO RESCIND RESOLUTION N0. 87-112 AND TO ADOPT A
REVISED RESOLUTION ON THE FORMATION OF COUNTY SERVICE AREA
N0. 100 - HOLLY GARDENS
WHEREAS, on the 4th day of August, 1987, the Butte County Board of
Supervisors adopted Resolution No. 87-112; and
WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the
Government Code of the State of California, Garian Inc, has petitioned the Local
Agency Formation Commission for the formation of County Service Area No. 100; and
WHEREAS, the Local Agency Formation Commission of the County of Butte
has approved the formation of County Service Area No. 100.
NOW, THEREFORE, IT IS HEREBY RESOLVED that Resolution No. 87-112 is
rescinded, and that County Service Area No. 100 is proposed to be established
under the terms of the aforesaid chapter in the unincorporated area of Butte
County.
1. The boundary lines of the territories proposed for inclusion in
the county service area are described in Exhibit "A" attached hereto and made
a part hereof by this reference.
2. The county service area shall be called County Service Area No.
100 (Holly Gardens). The types of extended services to be provided are street
lighting, storm drainage maintenance, and a sewer pump station.
3. The Board intends to levy a service charge to pay for the above-
mentioned services in County Service Area No. 100. The service charge will be
assessed in accordance with Government Code Section 25210.77(a) and the Butte
County Code, Sections 21-85 through 21-90. Said service charge will not be
assessed until review and adoption of a report to be considered at a public
hearing scheduled for the 87/88 fiscal year.
On October' 20, 1987, at 11:00 a. m., a public hearing will be
held on the establishment of said area.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this 1st
day of September , 1987, by the following vote:
AYES: Supervisors Fulton, McInturf, Uercruse and Chair Dolan
NOES: None
ABSENT: Supervisor McLaughlin
