N*~ •,+~ CpUT3'~.~~ Resolufion No. 87-249 ~•i~~a 11y~~ RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS GIVING NOTICE OF THE PROPOSED FORMATION OF THE BERRY CREEK COMMUNITY SERVICES DISTRICT, FIXING TIME AND PLACE OF HEARING OF PROTEST AND DIRECTING THE GIVING OF NOTICE THEREOF WHEREAS, registered voters have submitted a written petition requesting formation of a Community Services District in order to obtain urban services as described herein to properties located within that area designated as Exhibit "A" attached hereto and by this reference made a part hereof; and WHEREAS, said California Community Services District is to be known as the Berry Creek Community Services District and is to be established pursuant to the provisions of Government Code Section 61000 et seq.; and WHEREAS, the purpose of said Community Services District is to provide a funding mechanism for the ownership and maintenance of a community water system; and WHEREAS, the Butte County Local Agency Formation Commission held a public hearing on October 1, 1987, and after due consideration approved the establishment of the Berry Creek Community Services District by adoption of Resolution 87-28; and WHEREAS, said Resolution 87-28 designated Butte County as the conducting authority and directed initiation of formation proceedings. NOW, THEREFORE, be it resolved by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That Tuesday, the 27th day of October, 1987, at the hour of 9:30 a.m. in the Board of Supervisors Chamber of the Butte County Administration Building, 25 County Center Drive, Oroville, California, is hereby fixed as the time and place for hearing of written protests against said Community Services District formation. 2. That the Clerk of the Board of Supervisors is hereby directed to give notice of the time and place of hearing as provided by Sections 61105 and 6066 of the Government Code. 3. That any interested person desiring to make a written protest against the proposed Community Services District formation shall do so by written communica- tion filed with the Clerk of the Board of Supervisors no later than the time and date of the hearing. Land owners shall include a description of the land owned by them, and registered voters shall indicate the address of their residence. The foregoing resolution was introduced at a regular meeting of the Butte County Board of Supervisors on the 6th day of October, 1987, by Supervisor Fulton , who moved its adoption, seconded by Supervisor Mclnturf and ordered adopted by the following vote: AYES: Supervisors Fulton, McInturf, McLaughlin, Vercruse and Chair Dolan NOES: None ABSENT: None {~ (~ NOT VOTING: None II 1 \ OLAN, Ch`hir County Board of Supervisors ATTEST: ` MARTIN J. Excepting therefrom the following described parcel of land: COMt~ENCTNG at the one-quarter Section corner between Sections 34 and 35, Township 21 North, Range 5 East, M.D.B.& M.; thence North 88 58t.East along the East and West center line of above mentioned Section 35, a distance of 144.00 feet; thence North 49 20t West, a distance of 872.00 feet; thence North 52 04' West, a distance of 47$.95 feet to the Section line between above mentioned Sections 34 and 35; thence South 1 18' West along said section line, a distance of 975.21 feet to the point of beginning and containing 13.31 acres, more or less. ~,~,3
