HomeMy WebLinkAbout87-255*~ ~, , ~a; ~, 'r_~ _ ~,..-~f` ° `,yam ~~ " ~: BEARD OF SUPERI~ISORS '}~ CQl_1NTY C7F E31 ITTE, .STATE OF _.CAL_IFORNlA ~ ~+ ~• _ _ Resolution No. 87-255 APPROVAL FOR APPLICATION FOR TENTATIVE PARCEL MAP The Board of Supervisors of the County of Butte, State of California, hereby resolves as follows: WHEREAS, finding that this project conforms to the Butte County General Plan and Zoning, and WHEREAS, finding that although this project could have had a significant impact on the environment, it will not in this case, provided the mitigation measures proposed by the applicant are complied with, and WHEREAS, those mitigation measures are numbers 1 through 7 as noted on the Planning Department conditions (copy attached hereto). NOW BE IT RESOLVED that: The applicant's appeal of the Advisory Agency's denial of his project is upheld and the tentative parcel map for Triple Ott Ranch Estates A.P. 28-17-160 and 162 is approved. Approval of the tentative map is subject to Public works conditions 1 through 9 and Environmental Health conditions 1 through 7 and Planning conditions 1 through 7 as noted on attached sheets. NICHOLS, Chief Administrative Officer and Clerk of the Board BY._ ~~~~ PLANNING DEPARTMENT CONDITIONS Information has been received from the Department of Fish and Game revising their letter of February 13, 1986. They indicate the property is within the "developable" zone within the migratory deer herd area. Development can proceed in this zone provided that setbacks are established from streams in accordance with their recommendations and fees are submitted at the time of final map recordation and building permit issuance. Recommend approval subject to the following mitigation measures: 1. Show a 300 foot vegetation retention are and no development area along Natchez Creek. 2. Show homesite locations east of Robinson Mi11 on the final map. The homesite on Parcel 1 should be located between the 1,525 and 1,550 foot contour lines. 3. Note on Map: Driveway locations to be approved by the Department of Public forks via encroachment permits. 4. Utilize standard erosion control measures and construction practices to minimize erosion potential for any improvements required prior to filing a final map. 5. Place the erosion control note (4) on the final map relative to driveway and site preparation. 6. Note on Map: Owner agrees to pay the deer mitigation fees required by County ordinance for issuance of building permit{s) at the time such permit(s) are issued. Owner acknowledges that no such ordinance is in effect as of the date of tentative subdivision map approval. 7.
