OF C.ALIFOR?tilA Resolution No. g7~266 RESOLUTION AUTHORIZING EXECUTION OF PROGRAM SUPPLEMENT N0. 46 TO MASTER AGREEMENT N0. 03-5412 RE: FEDERAL-AID PROJECTS WIDEN SHOULDERS, CULVERTS, INSTALL SIGNS, AND PLACE PAVEMENT MARKINGS, PROJECT N0. HES-0005(275) BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That said County approve Program Supplement No. 46 to Master Agreement No. 03-5912 for Federal-Aid Projects in Butte County and the Chair of the Board be authorized to execute said supplement on behalf of said County. Supplement No. 46 covers widening of shoulders and culverts, installing signs, and placing pavement markings along various County roads, Project No. HES-OOOS(275). 2. That Clerk of this Board be authorized to attach certified copy of this Resolution to Program Supplement No. 46. DATE: Sept . 2 8 , 19 $ 7 This Program Supplement is hereby incorporated into the Local Agency-State Agresmen# for Federal-Aid which was entered into between the LOCAL AGENCY and the STATE on. 5-23-78 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. 87-2$~ ,,approved by the LOCAL AGENCY en NOV. 3, 1987 (See copy attached). The Local Agency further stipulates that as a condit'son to payment of funds obligated to this project, it accepts and will comply with the convenants or remarks set forth on the following pages- PROJECT LOCATION: Various Locations on and off the Federal-Aid System. All maintenance, involving the physical condition and the operation of the improvements, referred to in Artical VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 2. In executing this Program Supplemental Agreement the Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Programs. 3. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 4. The Local Agency agrees the payment of Federal funds will be limited to the Detail Estimate amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement {PR-2), or its modification {PR-2A), and accepts any increases in Exchange Funds, State Matching Funds, and/or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 5. All required pavement markings and advance warning signs shall conform to the requirements of MUTCD, 1978 and shall be placed in their proper location. VD:cr 9/28/87
