RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
AUTHORIZING THE FORMATION OF AND ESTABLISHING THE BOUNDARIES
OF THE PROPOSED BERRY CREEK COMMUNITY SERVICES DISTRICT
WHEREAS, a petition signed by registered voters has been submitted
requesting formation of the proposed Berry Creek Community Services District;
and
WHEREAS, the Board of Supervisors has authorized notice of hearing
of said petition as required by the provisions of Government Code Section 61000
et seq.; and
WHEREAS, the Board, on October 27, 1987, at the hour of 9:30 a.m.,
conducted a public hearing on the formation of the proposed District, and has
heard all relevant evidence in support of or in opposition to the petition; and
WHEREAS, the Board has determined that the boundaries of the proposed
District, as submitted with the petition, and as described on Exhibit "A"
attached hereto, have been properly drawn and include all lands which will be
benefitted; and
WHEREAS, the Board, based on the evidence presented, has determined
that no additional land should be included within the boundaries of the proposed
District; and
WHEREAS; the Board has determined that no lands included within the
petition as being within the District should be excluded as not being benefitted;
and
WHEREAS, the Board finds that the Petition conforms to the requirements
of Section 61103 of the Government Code of the State of California, and that the
required notice of the hearing has been given.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the
County of Butte that the Board does hereby establish and describe the exterior
boundaries of the proposed Berry Creek Community Services District as being
those boundaries depicted on Exhibit "A", attached hereto and by this reference
incorporated herewith.

BE IT FURTHER RESOLVED that the proposed District shall be called
the BERRY CREEK COMMUNITY SERVICES DTSTRTCT.

AYES: Supervisor Fulton, Mclni:urf, McLaughlin and Chair Dolan

ABSENT: Supervisor Vercruse

ALL that real property situate in the County of Butte, State
of California described as follows:
The Northwest quarter of Section 35, Township 21 North, Range
5 East, M.D.B.& M.
Excepting therefrom the following described parcel of land:
COMMFNCYNG at the one-quarter Section corner between Sections
34 and 3S, Township 21 North, Range 5 East, M.D.B.& M.;
thence North 88 58' East along the East and West center line
of above mentioned Section 35, a distance of 144.04 feet;
thence North 49 24' West, a distance of $72.40 feet; thence
North 52 44' West, a distance of 4T$.95 feet to the Section
line between abave mentioned Sections 34 and 35; thence South
1 18' West clang said section Line, a distance of 975.21
feet to the point of beginning and containing 13.31 acres,
more or less.
