Resolution No. 87-272
APPROVAL FOR APPLICATION FOR TEi~7TATIVE PARCEL MAP
The Board of Supervisors of the County of Butte, State of California,
hereby resolves as follows:
wHFRFas, finding that this project conforms to the Butte County General
Plan and Zoning, and
WHEREAS, finding that although this project could have had a significant
impact on the environment, it will not in this case, provided the mitigation
measures proposed by the applicant are complied with, and
WFTF'RFAfi, those mitigation measures are numbers 1 through 7 as noted on
the Planning Department Memo (copy attached hereto).
NOW BE IT RESOLVED that:
The applicant's appeal of the Advisory Agency's denial of his project
is up held and the tentative parcel map for Roy and Carol Napier, AP 71-06-49
and 71--14-21 is approved. Approval of the tentative map is subject to Public
Works conditions 1 through 11 and ~nironmental Health conditions 1 and 2 and
Planning conditions 1 through 7 as noted on attached sheets.
PASSID AND ADOPTED by the Butte County Board of Supervisors this 17th
day of November 1987, by the following vote:

1 Provide two-way traversable access RS-8-LD--III to each parcel from
a county maintained road or state highway.
2 Access to be reserved in deeds as per county ordinance and offered
for dedication on the final map.
3 Show 50 ft. building setback line measured from centerline of access
easement.
4 Provide road maintenance agreement.
5 Indicate a 50 ft, building setback from the centerline of Lumpkin Rd.
6 Show all easements of record on the final map.
7 Provide street name signs per requirements of the Department of
Public Works prior to recordation of the final map.
8 Provide cul-de-sac at the end of the street.
9 Obtain encroachment permit and construct standard road approach
providing adequate sight distance at the intersection of access road
and Lumpkin Road
10 Pay any delinquent taxes or current taxes as required.
11 Meet the requirements of the Butte County Fire Department.

This department has advised the Butte County Department of Public
i•lorks Land Development Section that we are prepared to act on the
above application.
Based on present information, we can recommend approval or
conditional approval.
RECOMMENDED CONDITIONS FOR APPROVAL
1. show a 50' leachfield setback from the drainage way on• parcels
1, 2, and 3.
2. Prove that the required quantities of domestic water are
available to parcels 1, 2, and 3.

suo~ecr 'T'ENTATIVE PARCEL MAP FOR ROY NAPIER ON AP 71-14-21 and 71-06-49
DATE: November 4, 1987
The purpose of this Tentative Parcel Map is to divide 146 acres
into three parcels: ane large parcel. of 116 acres and two
smaller parcels of 10 acres each. The Planning Director recom-
mends approval of this Tentative Parcel Map, subject to the
following conditions:
1. A11 new hamesites shall be located within 660 feet of the
outside right-of-way of Lumpkin Road. This area shall be
designated an the map as a development area. Said develop-
ment area shall exclude any area with 15$ or greater slope,
stream setbacks as detailed below, or archaeological sites.
2. All areas exceeding 15$ slope shall be designated on the
final map as no-develapment areas.
3. The final map shall designate a 100-foot building setback
from permanent streams and a 50-foot setback from inter-
mittent streams.
4. There are three recorded archaeological sites included in
this map. These sites, together with a surrounding area
sufficient to protect the resources from encroachment,
shall be designated on the final map as a no-development
area.
5. A11 property, except for homesite areas, shall be shown as
a native vegetation retention area. Within this area,
native vegetation may be selectively thinned to improve
wildlife habitat or reduce fuel loads, but large-scale
clearance of vegetation is prohibited.
5. Note on the map: "Owner agreed to pay the deer mitigation
fees required by County Ordinance at the time building
permits are issued, provided such an ordinance is in effect
as of that date."
7. Note on the map and record in the deeds that current or
future owners agree not to appose the formation of any
special district for the purpose of upgrading or aligning
Lumpkin Road.
