II 5 6 7 8. 9~ ; 10` 11 12 13? 1.4' 15` 16 i 18' 19 20 21: 22 23 24 25 26 27 28 29 30 s 37 32 ORDINANCE N0. 874 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CAT IFORL~TIA, PURSUANT TO ORDINANCE NOS. 475, 522 and 676 OF SAID COUNTY The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475 of said County as amended by Ordinance Nos. 522 and 676 do ordain as follows: SECTIODT 1. The hereinafter described area situate in the County of Butte, State of California, shall be :and is hereby zoned as an "M-2" (Heavy Industrial) District. as hereinafter descri~red and subject to all the restricted uses applicable to the uses of an "M-2" District. Said area so zoned being located in the unin- corporated area of Butte County, south of the City of Oroville, particularly described as follows: 1.1 Assessor Parcel No. 36--5'0-14 as shown by mad in the Office of the County Assessor, first Monday in March 1966. 1.2 Assessor Parcel No. 36-52-4 as shown by map in the Office of the County Assessor, first Monday in Niarch 1966. 1.3 Assessor Parcels No. 36-53-9 & 10 as shown by map in the Office of the County Assessor, first Monday in March 1966. SECTION 2. .The following uses shall apply in an "M-2" (Heavy Industrial) District: 2.i Uses permitted: 1} Any uses permitted in the C, MP and M-1 Zones. 2) The industrial enterprises which involve the bulk handling of products manufactured, heated, processed,. or assembled on the premises, the dominant amounts of storage and warehousing, the heavy trucking or use of heavy duty •: ~.:. equipment, the heavy movement of traffic on the site and the generating of largea~munhts of automobile and truck traffic an the adjacent streets, the noise and vibration, sites larger than can be provided in normal sized lots, and similar characteristics and performance standards nat detrimental in effect upon other uses of similar nature in close proximity. 2.2 Any use for which a Use Permit is required in an "A-2" District, upon application for and granting of a Use Permit. Because of the considerations of smoke, fumes, dust, odor, vibration or hazard, the establishment or operation of the uses as described in the "A-2" District shall not .be per- mitted unless a conditional Use Permit authorizing such uses has been granted. 2.3 PERMITTED HEIGHT: No height limit is impgsed. 2.4 FRONT YARD REQUIRED: Conform with County building setback requirements. 2.5 SIDE XARD REQUIRED: P7one, except where th.e side a lot which abuts an "R" District, in which case the side yard shall not be less than ten (10) feet. ~~~ 2.6 REAR YARD: None except where the rear yard abuts '1 an "R" District, in which case the rear yard shall not be less then ten (10) feet. ,2 2.7 LOADING AREA: Private off-street 1Qading space fox 3' the handling of all goods, materials and equipment shall be provided. 4 2.8 PARKING SPACE: One (1) parking space for each 5 three (3) employees or one (1) parking for each two thousand (2,000) square feet of gross floor space, °-whichever is 6, greater. 7 2.9 FENCE: On any boundary line which is a common property line with property classified for uses permitted in 8 the "R" category or the "S" zone, a solid wall or view- obscuring fence not less than five (5) feet nor more-than sia~ g (6) feet in Height shall be installed and maintained for screening purposes and controlling taEespa.ss except where the 10; wall of a building is on such common boundary line na sxeparat wall need be installed along the portion of the boundary linE 11 occupied by the wall of the building. 12 SECTION. 3. All uses of land within the district not specifi- ca11y authorized and permitted under Section 2 are prohibited. 13 SECTION 4. Penalty for any violation of the zoning hereby 14 proposed within the district shall be as provided in the Zoning Enabling Ordinance and in compliance with the provision of the 15 Zoning Enabling Ordinance, this Ordinance shall be from and after its effective date a supplement to and part of the Zoning, Enablinc 16 Ordinance. 1'1' SECTION 5. In compliance with the provisiop.s of said Zoning Enabling Ordinance, the same is hereby amended by adding to lg Section 5 thereof this Ordinance in full.. 19 SECTION 6.
