HomeMy WebLinkAbout878ORDINAtiCE NO. ~L AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUAD7T TO ORDINAIQCE NOS. 475, l 522 and 675 OF SAID COUNTY ~ The Board of Supervisors of the County of Butte, State of Cali- fornia, under and pursuant to Ordinance No. 475 of said County, S. being the Zoning Enabling Ordinance of said County as amended by Ordinance Nos. 522 and 676, does ordain as follows: SECTION 1. The hereinbelow described area situate in the Count 5 of Butte, State of California, shall be and is hereby zoned as an A-3 (Agricultural) District and such area shall be subject to the restrictions and restricted uses and regulations hereinafter speci-- 7 fled and provided, said areas so zoned being located in the unin~- corporated area of Butte County, State of California, and particu- $ larly described as follows: General Plan Sectional- Map No. 1 as shown in the 9 offices of the Butte County Planning Commission 1~ and of the Butte County Clerk. SECTION 2. The following regulations shall apply in an "A-3" 11' District: 12 2.1 Uses Permitted: 13 a. Single Family Dwellings. b. General farming, horticulture, commer--_.. 14 cial-livestock, poultry production, warehouse and storage. c. Accessory buildings and uses pertinent to the 15 permitted uses, including agricultural processing plants. d. Housing facilities (including trailers) to accom- 16 modate only agricultural employees and their families employed by the owner or operator of the premises; and provided further that 17 such housing facility shall be considered accessory to the main building, -but shall conform to the provision pertaining to re- 18 quired yard and open space for dwellings. 19 2.2 The following uses subject to securing a Use .Permit in each case: 20 a. Golf courses and country clubs. b. Public or quasi-public uses including churches, 21 firehouses, hospitals and clinics, parks and playgrounds, schools, public utility buildings and professional buildings. 22 2.3 Minimum Lot Area Required: ~`ive (5) acres; except as 23 redesignated in Section 3.1 of this ordinance. 2~ SECTIOid 3. Additional uses permitted subject to the securing of a Use Permit in each case: 25 3.1 For property having frontage an Midway, west of the 26 intersection of State Hwy 99E (Richvale Wye): General Commercial (C-2) uses. Said commercial shall not exceed two thousand (2,000) 27 feet from the intersection and shall not exceed a depth of five hundred (500) feet on both sides of Midway. 28 3.2 For property having frontage on the Oroville-Willows 29 Road, west of State Hwy 99E: General Commercial (C-2) uses. This Ordinance is for the purpose of orderly pro- gress and the owner of any property zoned hereby may at any time petition the Planning Commission and the Board of Supervisors of the County of Butte for rezoning; and the Planning Commission of the County of Butte shall on each fifth .anniversary of the date of the adoption of this Ordinance, of its own accord, review said ordinance to determine whether or not any land zoned hereby should be rezoned to permit orderly progress. SECTION 5. All uses of land within the'~dsitric~ not specifi- cally authorized and permitted under Section`2~are'prohibited. SECTION 6. Penalties for any violation of the zoning hereby imposed within-the. District shall be as provided in the Zoning En~ ~ablina Ordinance. In compliance with the provisionsof the zoning Enabling Ordinance, this Ordinance shall from and after its effect-', ive date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 7. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen i15) days after its passage this Ordinance shall be published once with the. names of the members of the Board of Supervisors voting for and against it in the Gridley Herald , a newspaper published in the County of Butte, State of Californ~.a.
