Resolufion No. 88-022
RESOLUTION APPROVING AND EXECUTING THE AGREEMENTS BETWEEN THE
NORTH BURBANK PUBLIC UTILITY DISTRICT AND THE COUNTY REGARDING
THE EXCHANGE OF PROPERTY TAX REVENUES RELATED TO THE UNION
PACIFIC RAILROAD COMPANY AND McGAHA/MILLER ANNEXATIONS, AND
BETWEEN THE THERMALITO IRRIGATION DISTRICT AND THE COUNTY
RELATED TO THE GOLDEN FEATHER ANNEXATION
WHEREAS, the provisions of the Revenue and Taxation Code require
an agreement between the County of Butte and special districts considering
annexations.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that
the Agreements attached hereto as Exhibits A, B and C are incorporated herein
as set forth in full and are hereby approved and executed by Butte County.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this
23rd day of February 1988, by the following vote:
AYES: Supervisors Dolan, Fulton, McLaughlin, Vercruse and Chairman McInturf
NOES: None
ABSENT: None
NOT VOTING: None

This Agreement is made and entered into this 23rd day
of February , 198 8 by and between the County of Butte, a
political subdivision of the State of California, and the North
Burbank Public Utility District, an independent special district
authorized by the Public Utilities Code of the State of California.
WHEREAS, Part 0.5 of Division I, Sectian 99, Subdivision
B, paragraph 5 of the Revenue and Taxatian Cade provides as
follows:
"In the event that *** a jurisdictional change would
affect the service area or service responsibility of
one or more special districts, the board of supervisors
of the county or counties in which *** the districts
are: located shall, on behalf of the district or
districts, negotiate any exchange of property tax
revenues."
WHEREAS, said section of the Revenue and Taxation Code
further provides in Section 99.1, Subsection (1), paragraph 3:
"'Notwithstanding the provisions of paragraph (5) of
subdivision (b) of Section 99, any special district
affected by the jurisdictional change may negotiate on
its own behalf, if it so chooses."
WHEREAS, Section 99 further provides in Subsection B,
paragraph S, subpart {d):
"with respect to adjustments in the allocation of
property taxes pursuant to this section, a county and
any local agency or agencies within the county may

develop and adapt a master property tax transfer
agreement. Such agreement may be revised from time
to time by the parties subject to such agreement.'" ,
NOW, THEREFORE, in consideration of the premises herein-
before set Earth, the parties hereto agree that no property tax
exchange will occur as a result of the Union Pacific Railroad
Company Annexation to the North Burbank Public Utility District.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the date set forth below.

NOW, THEREFORE, in consideration of the premises herein-
before set forth, the parties hereto agree that no property tax
exchange will occur as a result of the McGaha/Miller Annexation to
the North Burbank Public Utility District.

Irrigation District, an independent special district authorized by
the Water Code of the State of California.
WHEREAS, Part 0.5 of Division I, Section 99, Subdivision
B, paragraph 5 of the Revenue and Taxation Code provides as

NOW, THEREFORE, in consideration of the premises herein-
before set forth, the parties hereto agree that no property tax
exchange will occur as a result of the Golden Feather Annexation
to the Thermalito Irrigation District.
