FISH AND WILDLIFE SERVICE WILDLIFE HABTTAT EASEMENT PROGRAM BY EMINENT DOMAIN WHEREAS, the Butte County Board of Supervisors have previously authorized the acquisition of property owned by Chambers, Davis and Meyer, Inc. into the U. S. Fish and Wildlife Service Wildlife Habitat Program consisting of approximately 317 acres of farmland; and WHEREAS, such acquisition by the U. S. Fish and Wildlife Service was conditioned upon such agency not utilizing its powers of eminent domain, although recognizing that such agency possesses such powers, and such limitation was agreed to by the U. S. Fish and Wildlife Service; and WHEREAS, the owners of the subject property and the U. S. Fish and Wildlife Service have requested as to this property, and only as to this property, such agency he permitted to utilize its powers of eminent domain as such exercise is in the best interest of both parties and the landowners. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors, County of Butte, State of California, as follows: 1. The U. S. Fish and Wildlife Service possesses all powers to acquire property into the Wildlife Habitat Easement Program. 2. The County of Butte does not object to the inclusion of real property described in Exhibit "A" owned by Chambers, Davis and Meyer, Inc. into the Wildlife Habitat Easement Program by the U. S.
