OF BUTTE, STATE OF CALIFORNIA ..• o 'U~ ~y ~ d~ ' Resolufion No. s8-os~ RESOLUTION GIVING NOTICE Off' HEARING ON PETITION TO ABANDON A STREET WHEREAS, this Bvard has received a petition from ten or more free--holders, requesting the abandonment of a street as described below, and at leaset two of the petitioners are residents of the road district in which some or part of the street proposed to be abandoned is situated and are taxable therein for street purposes; and WHEREAS; pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code, commencing with Section 8320, this Board shall set a date, hour and place for a hearing on the petition for abandonment. NOW, THEREI'ORE, BE IT RESOLVED by the Board of Supervisors: 1. That this Board hereby gives notice that at its regular meeting on July 12, 1988, at 11:00 a.m., in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California, a hearing shall be held to hear all persons interested in the abandonment of that street known as "Old" Glenwood Avenue extending from State Highway 32 along Lindo Channel to Glenwood Avenue in the Chico area of the County of Butte, State of California, which is described as follows: PORTION OF "OLD" GLENWOOD AVENUE AP 42-13-1 & 46 Parcel 1. - Being a portion of that certain 50 foot easement as described in the deed to Butte County, recorded in Book 113 of Deeds, at Page 203, in the Office of the Recorder of the County of Butte, State of California, also being a portion of Lot 68 of John Bidwell's 2nd Subdivision, recorded in Maps of Record, Book 5, at page 27, in the Office of the Recorder of the County of Butte, State of California, more particularly described as follows: Being all of that portion of said 50 foot easement lying westerly of and parallel with the easterly line of said Lot 68 that lies northwesterly of a line that is 30 feet northwesterly of and parallel with the existing centerline of Glenwood Avenue, as said centerline is shown on that center right-of-way map (File No. E-682) on file in the Office of the Butte County Department of Public Works, and southeasterly of the northwesterly lot line of said Lot 68 near the south bank of Lindo Channel. Reserving thereon a drainage easement over the easterly 25 feet of the above-described easement, to maintain, operate, replace, remove, renew, enlarge and install drainage facilities. Parcel 2. - Being all of that certain 50 foot easement as described in the deed to Butte County, recorded in Book 104, at Fage 370, in the Office of the Recorder of the County of Butte, State of California, also being a portion of Lot 72 of John Bidwell's 2nd Subdivision, recorded in Maps of Record, Book 5, at Page 27, in the Office of the Recorder of the County of Butte, State of California, more particularly described as follows: Being a strip of land 50 feet wide, lying southeasterly of and parallel with the northwesterly line of said Lot 72, bounded on the southwest by the northeasterly line of Lot 68 of said Bidwell's 2nd Subdivision and bounded on the northeast by the southwesterly right of way line of State Highway 32. RESERVING, however, to public utility companies, the right from time to time to install, maintain, repair, operate, replace, remove and renew facilities consisting of lines of pipes, wires, poles, and other structures, equipment and fixtures, both above ground and underground, for the operation of said facilities, together with the right of ingress thereto and egress therefrom across, upon, and in and under said Parcel 1 and Parcel 2. Said Map showing the rights of way to be abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, CA 95965. 2. That at the conclusion of said hearing the Board intends to abandon said street. 3. That this abandonment proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code {commencing with Section 8320). 4. That a map showing said street to be abandoned is on file at the Butte County Public Works Department, 7 County Center Drive, Oroville, California. 5. That this Resolution be posted and published pursuant to the provisions of Chapter 3 of Part 3 of Division 9 of California Streets and Highways Code.
