Program administered by the Office of Criminal Justice Planning (hereafter referred to as OCJP). NOW, THEREFORE, BE IT RESOLVED that the Chief Administrative Officer of the County of Butte is authorized, on its behalf to submit the attached proposal to OCJP and is authorized to execute on behalf of the County of Butte the attached Grant Award Agreement including any extentions or amend- ments thereof. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency. The State of California and OCJP disclaim responsibility for any such liability. UNIT PERSONNEL Prosecutors Investigators Support Staff GRANT FUNDED 1 1 1 (6 mos) COUNTY FUNDED 1 n 1 ~' Stets were reported by "case" and "individual defendants" up to June 1987. Per OCJP at the May 1987 Grant Conference the stars were changed, to begin July 1987 to report by "individual defendant". As a result, stets were terminated relative to "cases". It is now logistically impossible to ga back and attempt to re-create this statistic. Stets w~.ll continue to be reported on a "defendant" equals a "case" basis. ~~Overall conviction rate is somewhat lower based on a readjustment of the MNVP guidelines and subsequent purge of cases that no longer meet the criteria. Form MN-1 PROBLEM STATEMENT Butte County continues to be a major center for clandestine lab activity, cocaine sales, "Black Tar" heroin, and marijuana cultivation. Butte County also has an inordi- nantly high homicide rate, with several murders related to drug sales or manufacturing activity. Butte County has a service population of approximately 170,000 with 1,650 square miles of, largely rural and inaccessible areas. Butte County's low law enforcement levels and close proximity to major population areas makes a perfect haven for dealers, growers and lab operators. However, the consolidation of narcotics enforcement efforts in the Butte Inter-Agency Narcotics Task Force and MNVP appears to have impacted the narcotics problem. Statistics from the Oroville Police Department shows a significant reduction in Part I crimes. The Narcotics Task Force has increased its' rate of arrests by approximately 50~ from 1986 to 1987. The number of major cultivators of marijuana has decreased. Given the above impact on the narcotics traffic in Butte County, the number of felony cases in the system keeps rising. The only way to keep up the caseload is through multiple continuances, resulting in a dramatic increase in case closure rates. The MNVP guidelines are being studied for a second adjustment toward reducing the caseload and reducing the case duration. A County funded attorney, previously designated as 50~ MNVP backup and 50~ CAVP is being altered to 100 MNVP backup and to handle alI those cases submitted by the ,task force, which are not accepted by MNVP. Form MN- 2 PROGRAM OBJECTIVES OBJECTIVE 1: To vertically prosecute all MiT]VP defendants T. Of the 104 (total number) defendants prosecuted January 1, 1987 through December 31, 1987 _..~ percent were prosecuted with true vertical techniques. and I4 percent were completed with unit prosecution. ]4 percent were completed nan-vertically. (Should equal 100 percent). IT. In FY 1988/89. ~_ percent of all MNVP defendant's cases will be completed with true vertical prosecution techniques. III. The following procedures have been established to achieve true vertical prosecution: • All narcotics cases are reviewed by the Project Attorney. Those that do nat fall within the project guidelines are re-assigned to the other felony deputies. Retained cases are being handled in a true vertical prosecution manner, or are handled by the designated backup attorney in a unit vertical manner. IV. Problems encountered during the prior project year: Major trials assigned to the designated MNVP backup attorney and the impassibility of the Project Attorney covering three courts caused a shortfall in reaching the projected 75~ figure for true vertical techniques. However, true vertical prosecution was increased by I7~, unit vertical was reduced by 2~ and non-vertical prosecution was reduced by 15~, as compared to 1986. Form MN-3a PROGRAM OBJECTIVES OBJECTIVE 2: To reduce, by a minimum of ane-third (33%} the P'iI+IVP prosecutor's caseload. X. From January 1, 1987 through December 31, 1987 the average caseload of the # MNVP unit prosecutor was 100 cases as compared to other felony prosecutors in non-vertical units with an average caseload of 92 cases. II. In FY 1988/$9 the MNVP prosecutor will carry a maximum of 62 cases. This is at least a one-third reduction in the average felony caseload carried by non-vertical deputies. III. The following procedures and policies are in place to achieve this objective. New guidelines are being prepared to raise the criteria for cases to be accepted by the MNVP Unit, In addition, current cases not meeting those adjusted guidelines will be reviewed for rejection from MNVP. IV. Problems encountered during the prior project year: Major problems still arise in the area of diversion hearings and pre-trial motions on narcotics cases. The increased rate of arrests by the &utte Inter-Agency Narcotics Task Force continues to impact the system. As a result of their activities more major dealers and manufacturers are being identified and arrested. 'This is a deceptive statistic based on the conversion from "cases" to "defendants". Last years R.F.P. showed 65 cases as the caseload. This statistic equated to 117 defendants. The project has been able to reduce caselo ad somewhat as indicated above, while non-MNVP caseload has increased dramatically. Form MN-3b . PROGRAM OBJECTIVES OBJECTIVE 3: In appropriate cases and utilizing reasonable prosecutorial efforts, to prevent the pretrial release of a charged defendant meeting MNVP Program criteria. I. Of the 104 (number} defendants with completed cases from January 1, 19$~ through December 31, 198 ~~ percent remained in custody at the time of their trial. II. In FY 1988/89. ~_ percent of all MAFVP defendants will remain in custody at the time of their trial. III. Established actions} taken to prevent a defendant's pretrial release: Project staff resists O.R, releases and requests current hail or increased bail routinely. Due to a recent lawsuit involving the Butte County Jail, there is a court ordered O.R. Release Program mandating a maximum jail population. If jail population exceeds this figure, defendants are ordered released on O.R. prior to arraignment. Project will continue to resist O.R. releases and to file 1275 motions. IV. Problems encountered during the prior project year. The major problem for pre-trial releases is the Superior Court ordered "consent decree" which mandates an O.R, Release Program and a maximum jail population. In addition, low bail figures in major narcotics offenses contributes to early release. The number of defendants in custody has increased by 5~ over 1986. Form MN-3c K PROGRAM OBJECTIVES OBJECTIVE 4: To utilize reasonable prosecutorial efforts to ensure that the most severe authorized sentence is imposed ugon a convicted defendant. I. Of the 104 (number) of defendants with completed case prosecutions from January 1, 1987 to December 31, 1987 70 percent were convicted. - g (number) ar ~ percent of the convicted defendants received the most severe authorized sentence. (Excluding enhancements. the one chaxge among all charges filed which results in the maximum time allowed under the determinate sentencing law and not the time that a judge might impose using his/her own discretion). II. In FY 1888/89 ~_ percent of all convicted MNVP defendants will, receive the. most severe authorized sentence. III. Established action{s} taken to secure the mast severe authorized sentence: It is the policy of the Superior Court for the County o£ Butte to not recognize sentence bargaining. Therefore, the MNVP Unit attorney appears at sentencing on Unit cases, files statements in aggravation,.and argues strenuosuly for the most severe authorized sentence. IV. Problems encountered during the prior project year: None that can be addressed, Form MN-3d PROGRAM OBJECTIVES OBJECTIVE 5: To reduce the amount of time between the arrest and disposition of charges against a defendant meeting MNVP Program criteria. I. From January 1, 1987 to December 31. 1987 the average amount of time between arrest and disposition for MNVP defendants was 3l9 days. The average amount of time required to far felony defendants in non-vertical units was X17 days. (Tf office-wzde data is unavailable use a sample of felony cases}. TT. in FY 1988/88 the average amount of time to adjudicate a MNVP defendant will be 200 days. III. Established action(s) taken to reduce the amount of time between arrest and disposition of charges for MNVP defendants. MNVP has developed and adds to a bank of points and authorities dealing with _ ~ -the complex motions filed in narcotics cases. Word processing capabilities enable quicker responses to these motions. A 100 unit backup is being assigned to assist with MNVP cases. II. Problems encountered during the prior project year: Complex motions, diversion hearings, increased arrests and backup unavailability due to trials has necessitated multiple continuances in project cases, causing an increase in the average time for case closure. In addition, there has been an increase in failures to appear by the defendant, and several defendants who were sought on warrants have been apprehended. Form MN-3e PROGRAM OBJECTIVRS OBJECTIVE 6: To increase the conviction rate of MNVP defendants. I. From January 1, 1887 to December 31, 198'], 104 (number) MNVP defendants were prosecuted. Of this number charges against 30~ percent of the MNVP defendants were dismissed, 0 percent were found not guilty and 70 percent were found guilty. This represents a 70~ MNVP unit conviction rate. The office felony conviction rate for this period was 73~ (If office-wide data is unavailable use a sample of felony cases}. II. In FY 1g88/8g, ~Q percent of the MNVP defendants will be convicted. III. Established action(s) taken to increase the conviction rate of MNVP defendants. Utilizing expertise gained from past cases, and by reducing project caseloads through more restrictive office guidelines, should result in a higher conviction rate of MNVP Unit cases. IV. Problems encountered during the prior project year: The purge of MNVP cases, due to more restrictive guidelines established in April of 1987 resulted in a decrease in the overall MNVP conviction rate. This statistic also. includes exceptional closures of cases that were initially MNVP but rejected on review aftier the intake criteria was revised early in 1987. The Project Attorney and investigator will prepare monthly reports of unit activity. These reports will be used by the Froject Director to prepare the Quarterly reports which will be forwarded to the Office of Criminal Justice Planning. Form MN-6 f r~LAN FOR ASSUMPTION OF COSTS Every effort will be made by the project director to insure the continued funding of the Major Narcotic Vendor Prosecution Program after the grant period. The project director will work closely with the Butte County Administrative Office and County Auditor to advocate for the utilization of county funds for the continued funding of the program. Funds will also be sought from outside the county government in the form of grants from appropriate funding=sources, both public and private.
