Resolutiott No. 88-074
RESOLUTION SUPPORTING THE LIMITING
OF JOB STRESS CLAIMS
WHEREAS, jab stress claims have become the fastest growing
type of workers' compensation claim; and
WHEREAS, the California Workers' Compensation System
was never designed to deal with claims in which employees said
they were suffering from routine and cumulative emotional job stress;
and
WHEREAS, the number of county government's claims and
the cost are higher for stress claims than any other workers`
compensation injury, totalling nearly $70 million a year statewide;
and
WHEREAS, a special California legislative committee,
the Conference Committee on SB 323 (Lockyer), is working diligently
for workers' compensation reform, and
WHEREAS, the Governor has developed a proposal for workers'
compensation reform, including a provision to limit questionable
job stress claims; and
IdHEREAS, the likelihood of major reform to the California
lJorkers' Compensation System is the best in many years;
NOW, THEREFORE, BE IT RESOLVED, that the Butte County
Board of Supervisors urges the Governor and the Legislature to
limit job stress claims in their legislative provisions including:
The elimination of job stress claims which result
from pressures and tensions ordinarily encountered
by employees performing the same or similar kind of
work; and
The elimination of job stress claims filed by workers
caused by personnel actions such as demotions, job
transfers, reclassifications and terminations.

this 7th day of June, 1988, by the following vote:
AYES: Supervisors Dolan, Fulton, McLaughlin, Vercruse and
Chairman McInturf
