TO ABANDON A PUBLIC UTILITY EASEMENT
WHEREAS, this Board has received a petition from five
or more free-holders, requesting the abandonment of the Public
Utility Easement as described below; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9
of the California Streets and Highways Code, commencing with
Section 8320, this Board shall set a date, hour and place for a
hearing on the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors:
1. That this Board hereby gives notice that at its
regular meeting on July 26, 1988 , 1988, at 11:00 a.m. in the
Board Chambers, Butte County Administration Building, 25 County
Center Drive, Oroville, California, a hearing shall be held to
hear all persons interested in the abandonment of that certain
Public Utility Easement located within Lot 185, Kelly Ridge
Estates Unit No. 1, in the Oroville area of the County of Butte,
State of California, and described as follows:
PUBLIC UTILITY EASEMENT
LOT 185, KELLY RIDGE ESTATES NUIT N0. 1
AP 69-14-37
Being a portion of that certain 10 foot public utility
easement lying within Lot 185, Kelly Ridge Estates Unit
No. 1, recorded in Book 38, Maps of Record, at Pages 5
to 10, County of Butte, State of California, more
particularly described as follows:
Being a portion of the 10 foot public utility easement
lying parallel with and contiguous to the southeasterly
lot line of said Lot 185, commencing at the most
easterly corner of said lot; thence South 68 degrees
06'12 " West along said lot line 30 feet to the Point
of Beginning; thence continuing along said lot line
South 68 degrees 06'12 " West 70.82 feet to the most
southerly corner of said Lot 185; thence North 21
degrees 47'48 " West along the southwesterly lot line
of said lot, 10 feet; thence North 68 degrees 06'12 "
East along the most northerly line of said easement
70.82 feet; thence South 21 degrees 47'48 " West 10
feet to the point of Beginning and the end of the
described easement.
Said Map of the Public Utility Easement to be abandoned
is on file in the Office of Butte County Department of Public
Works, 7 County Center Drive, Oroville, California 95965.
2. That at the conclusion of said hearing the Board
intends to abandon said Public Utility Easement.
3, That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with Section 8320).
4. That this Resolution be posted and published
pursuant to the provisions of Chapter 3 of Part 3 of Division 9
of the California Streets and Highways Code,
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 21st day of June ~ 19 gg ~ by
the following vote:
AYES: Supervisors Dolan, Fulton, McLaughlin and Vercruse
NOES: None
ABSENT: Chairman McInturf
NOT VOTING: None
