N ~ COUNTY' OF BUTTE, STATE OF CALIFORNfA . r,, ~+~' ~~ L t~ . ~ ~: ~ ~, '~~ R esojufion No. 88-104 RESOLUTION APPROVING AND EXECUTING THE AGREEMENT BETWEEN THE NORTH BURBANK PUBLIC UTILITY DTSTRTCT AND THE COUNTY REGARDING THE EXCHANGE OF PROPERTY TAX REVENUES RELATED TO THE VILLA VERONA II ANNEXATION WHEREAS, the provisions of the Revenue and Taxation Code require an agreement between the County of Butte and special districts considering annexations. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that the Agreement attached hereto as Exhibit A is incorporated herein as set forth in full and is hereby approved and executed by Butte County. NICHOLS Chief Administrative Officer and Clerk of the Board of Supervisors By 0.-~~-.- EXHIBIT "A" PROPERTY TAX EXCHAI3GE AGREEMENT This Agreement is made and entered into this 11th Day of May, 1988, by and between the County of Butte, a political subdi- vision of the State of California, and the North Burbank Public Utility District, an independent special district authorized by the Public Utilities Code of the State of California. Whereas, Part Q.5 of Division I, Section 99, Subdivision B, paragraph 5 of the Revenue and Taxation Code provides as follows: "In the event that.....a jurisdictional change would affect the service area or service responsibility of one or more special districts, the board of supervi- sors of the county or counties in which.....[the] dis- tricts are are located shall, on behalf of the dis- trict or districts, negotiate any exchange of property tax revenues." WHEREAS, said section of the Revenue and Taxation Code further provides in Section 99.1, Subsection (1), paragraph 3: "Notwithstanding the provisions of paragraph (5) of subdivision (b) of Section 99, any special district affected by the jurisdictional change may negotiate on its own behalf, it it so chooses." WHEREAS, Section 99 further provides in Subsection B, paragraph 8, subpart (d): "with respect to adjustments in the allocation of property taxes pursuant to this section, a county and any local agency or agencies within the county may develop and adopt a master property tax transfer agreement. Such agreement may be revised from time to time by the parties subject to such agreement." NOW, THEREFORE, in consideration of the premises set forth herein, the parties hereto agree that no property tax exchange will occur as a result of the Vi11a Verona II Annexation to the North Burbank Public Utility District. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the date set forth below.
