ANNEXATION WHEREAS, the provisions of the Revenue and Taxation Code require an agreement between the County of Butte and special districts considering annexations. NOW, THEREFORE, SE IT RESOLVED by the Board of Supervisors of the County of Butte that the Agreement attached hereto as Exhibit "A" is incor- porated herein as if set forth in full and is hereby approved and executed by Butte County. PASSED AND ADOPTED by the Butte County Board of Supervisors on this 12th day of July 1988, by the following vote: AYES: Supervisors Dolan, Fulton, McLaughlin and Chairman McInturf NOES: None ABSENT: Supervisor Vercruse NOT VOTING: None SKEL A. NICHOLS Chief Administrative Officer and Clerk of the Board of Supervisors By AGREEMENT 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 ~.8 19 20 I 21 22 '. 23 24 25 2B This Agreement is made and entered into this 12~h day of~ July 1988, by and between the County of Butte, a political subdivision of the State of California, and the Paradise Irrigation District, an independent special district authorized by the Water ~ Code of the State of California. WHEREAS, Part 0.5 of Division Z, Section 99, Subdivision B, paragraph 5 of the Revenue and Taxation Code provides as follows: "In the event that * * * a jurisdictional change would affect the service area or service responsibility of one or more special districts, the board of supervisors of the county or counties in which * * * the districts are located shall, on behalf of the district or districts, negotiate any exchange of property tax revenues." WHEREAS, said section of the Revenue and Taxation Code further provides in Section 99.1, Subsection (a}, Paragraph 3: "Notwithstanding the provisions of paragraph (5} of sub- division (b) of Section 99, any special district affected by the jurisdictional change may negotiate on its own behalf , if it so chooses . " WHEREAS, Section 99 further provides in Subsection B, paragraph 8, subpart {d}: "With respect to adjustments in the allocation of property taxes pursuant to this section, a county and any local agency. or agencies within the county may develop and adopt a master property tax transfer a 2 3 4 5 6 '7 8 9 3.0 I1 12 13 14 15 16 17 Z8 19 20 21 22 23 24 25 26 agreement. Such agreement may be revised from time to time by the parties subject to such agreement." NOW, THEREFORE, in consideration of the premises herein- before set Earth, the parties hereto agree that no property tax exchange will occur as a result of the Phillips/Edwards and Gross/ Ralston et al.
