HomeMy WebLinkAbout88-107RESOLUTION FOR JOINING CFIA WHEREAS, by Agreement dated April 1, 1986, as amended on December 30, 1986, August 11, 1987 and on February 5, 1988 (the "Joint Powers Agreement"), the State of California, Department of Food and Agriculture, the State of California, Department of General Services, and the County of Santa Clara, formed a joint powers agency known as the California Fairs Insurance Authority; and, WHEREAS, the purpose of the California Fairs Insurance Authority is to provide comprehensive liability and workers' compensation insurance coverage to entities which conduct fairs including counties contracting with non-profit corporations to conduct fairs pursuant to California Government Code Section 25905 and 25906; and, WHEREAS, the County of Butte (the "County") contracts with a non-profit corporation known as Butte County Fair Association, to conduct the County Fair pursuant to Government Code Section 25905 and 25906; and, WHEREAS, County has determined that it can receive specified insurance coverage at a reduced cost through the California Fairs Insurance Authority and that the cost reduction will benefit County; and, WHEREAS, County is empowered to enter into such a Joint Powers Agreement on behalf of the Butte County Fair Association; NOW, THEREFORE, BE IT RESOLVED that the Chairman is authorized and directed to sign the Joint Powers Agreement in order that the County will become a party to and a member of California Fairs Insurance Authority. BE IT FURTHER RESOLVED that County agrees to be bound by and adhere to all of the terms, conditions, rules and policies of the California Fairs Insurance Authority. BE IT FiTRTHER RESOLVED that the California Fairs Insurance Authority is authorized to settle and dispose of all claims or liabilities brought against the County and/or Butte County Fair Association to the extent California Fairs Insurance Authority provides insurance coverage to the County and/or Butte County Fair Association, and to the extent such action is consistent with the terms and conditions of the policies or coverages offered by CFIA, PASSED AND ADOPTED by the Butte County Board of Supervisors this 12th day of July 19 88 by the following vote: AYES; Supervisors Dolan, Mr.Laughl7n, Fulton and Chairman ~9cInturf NOES: None ABSENT; Supervisor Vercruse NOT VOTING; None HASKEL McINT RF, Chai of the Butte County Board of Supervisors ATTEST: MARTIN J.
